Conducts against the election code of conduct: This ‘Constituent Assembly Member Election 2008 Observation Bulletin’ was prepared by the National Election Monitoring Alliance (NEMA) on April 9, 2008

1. CPN Maoist cadres prevented CPN UML booth representatives from getting into their respective polling booths of 10 VDCs in Dhadhing Constituency – three Dhadhing, district on April 9, 2008. Likewise, CPN Maoist cadres also prevented Dhadhing Constituency-three candidate from Rastriya Prajantra Party Mr. Jit Bahadur Bhandari and his cadres from going to their poling center in Pira VDC, Dhading district.

The above incidents draw attention to following codes of ‘The Code of Conduct on Election to Members of the Constituent Assembly 2007′:

Code No 31 – No person shall distract any employee associated with election and the security personnel from responsibility to maintain peace and security from his or her duties by way of showing or exercising any kind of fear, terror, threat or force or showing gratification.

Code No 34 – No person shall do, or caused to be done, any act in such a manner as to disturb the election or create hatred toward election or create confusion or cause obstruction to election.

2. Janadisha National Daily published from Kathmandu on April 9, 2008 has published in its last page a feature on Voters’ thoughts titled, “Let’s Vote for CPN Maoist”.

The above incident draws attention to following code of ‘The Code of Conduct on Election to Members of the Constituent Assembly 2007’:

Code No 74 – No communication media shall carry any kind of election related publicity materials, political message or propagation of election campaign 48 hours prior to the polling day and such tacit period shall extend until the last polling center is closed.

However, this shall not impede the communication of information provided by Election Commission.

3. Madhesi Janaadhikar Forum Biswas faction has called for a strike in Dhuhabi, Sunsari district on April 9, 2008. The Biswas faction called for the strike stating “CA election as betrayal.”

The above incident draws attention to following code of ‘The Code of Conduct on Election to Members of the Constituent Assembly 2007’:

Code No 33 – No person shall stop, detain or block any candidate from canvassing election for election by committing such acts as using or showing fear, threat or terror or intimidation or force nor shall do, or caused to be done, any act in such a manner as to cause direct or indirect impacting the election.

4. A petrol bomb was detonated at the residence of NC Village Committee President Mr. Rana Bahadur Shahi in Maidi VDC in Dhadhing district on April 9, 2008. At the time of the incidence, NC meeting was taking place and the explosion has left NC cadres Mr. Sita Ram Thakur, Mr. Gyan Kumar Shahi, Mr. Lal Bahadur Raya, Mr. Gopal Raya, Mr. Theki Maya Sunar and Mr. Rana Bahadur Shahi injured. Nepali Congress has accused CPN Maoist behind the incident.

Code No 16 – No political party or candidate or their supporters shall disturb or obstruct any procession or mass meeting organized by another party or candidate.

Code No 34 – No person shall do, or caused to be done, any act in such a manner as to disturb the election or create hatred toward election or create confusion or cause obstruction to election.

5. CPN Maoist cadres torched Madhesi Janaadhikar Forum’s electoral campaign vehicle in Sunsari Constituency – three at Purbakusaha VDC in Sunsari district on April 8, 2008.

Code No 34 – No person shall do, or caused to be done, any act in such a manner as to disturb the election or create hatred toward election or create confusion or cause obstruction to election.

6. A clash took place between CPN UML and CPN Maoist cadres in Shankarpokhari VDC in Parbat district on April 8, 2008. In the clash, CPN UML district committee secretary Mr. Bikash Lamshal and two other CPN Maoist cadres and six security officials were injured.

Code No 34 – No person shall do, or caused to be done, any act in such a manner as to disturb the election or create hatred toward election or create confusion or cause obstruction to election.

7. Dhanusha Constituency – one Polling Officer Mr. Raj Kumar Kapar has been abducted from Duhabi VDC Pakhartol, Dhanusha district on April 8, 2008. Janatantrik Mukti Morcha cadre Mr. Abdul Birodhi has taken responsibility of the abduction.

8. Explosion has rocked five places in Rautahat district on April 8, 2008. Explosion occurred in Manpur VDC Bisunpurba, way to Garuda Samanpur, Dumariya VDC 4 Balchanpur, Baluwatol VDC, and Jayanagar VDC. Terai Army has taken responsibility of the explosions.

9. An unidentified group detonated a bomb at residence of Mr. Dukhi Mahato, Nepal United Marxist candidate for Siraha Constituency – six at Bishnupura VDC-7, in Siraha district on April 7, 2008. Mr. Mahato is currently undergoing treatment at District hospital.

Code No 33 – No person shall stop, detain or block any candidate from canvassing election for election by committing such acts as using or showing fear, threat or terror or intimidation or force nor shall do, or caused to be done, any act in such a manner as to cause direct or indirect impacting the election.

10. A total of four CPN Maoist cadres were injured in an explosion while they were making explosive devices in CPN Maoist Area In’ charge Lal Bahadur Dhami’s house in Gudukhani VDC Bajura district on April 7, 2008. After the incident, police raided the house and has confiscated materials used for making explosive devices. Along with the devices police also recovered a diary stating around 200-300 Peoples Liberation Army have already entered Bajura.

11. Young Communist League YCL cadres threatened with life to Mr. Deep Kumar Uppadhhya, NC candidate for Kapilvastu Constituency – one on April 8, 2008. Mr. Uppadhhya was threatened not to participate in election campaign.

12. CPN Maoist cadres attacked Nepali Congress cadres with sharp weapons in Simjung VDC 4, Gorkha district on April 8, 2008. On the attack two NC cadres namely Mr. Chet Bahadur Gurung and Mr. Dil Bahadur Tamang sustained injury. Injured individuals are currently undergoing treatment at Gandaki Zonal Hospital Pokhara.

13. A group CPN Maoist cadres led by Ms. Uma Karki, CPN Maoist candidate for proportional electoral system threatened villagers in Ankhibhuni VDC in Sankhuwasabha district to vote for their party, otherwise be ready for physical action, on April 8, 2008.

Code No 33 – No person shall stop, detain or block any candidate from canvassing election for election by committing such acts as using or showing fear, threat or terror or intimidation or force nor shall do, or caused to be done, any act in such a manner as to cause direct or indirect impacting the election.

14. On April 8, 2008, Kirat Workers Party and Kirat Rastriya Morcha threatened villagers in Jitpur VDC, Ilam not to vote in the Constituent Assembly election and pressurized candidates to withdraw their candidacy.

Code No 34 – No person shall do, or caused to be done, any act in such a manner as to disturb the election or create hatred toward election or create confusion or cause obstruction to election.

15. A clash took place between the YCL cadres and Armed Police Force (APF) personnel on April 8, 2008. A total of seven YCL cadres were killed in the incident. Other three cadres are in critical condition. District Administration Office has imposed curfew after the incident.

16. NC cadres beat up CPN Maoist cadres at Simikot VDC, Humla district on April 8, 2008. CPN Maoist cadres were injured who have been undergoing treatment at district hospital.

17. CPN Maoist cadres abducted Ms. Maya Adhikary, Radio Reporter from Andhikhola FM station from Bhorle VDC, Parbat district on April 8, 2008.

Code No 33 – No person shall stop, detain or block any candidate from canvassing election for election by committing such acts as using or showing fear, threat or terror or intimidation or force nor shall do, or caused to be done, any act in such a manner as to cause direct or indirect impacting the election.
Code No 34 – No person shall do, or caused to be done, any act in such a manner as to disturb the election or create hatred toward election or create confusion or cause obstruction to election.

18. A clash took place among NC, CPN Maoist and CPN UML cadres at Tokpur VDC, Ramechhap district on April 9, 2008 at 1230 hours. Mr.Keshav Kandle, CPN Moaist cadre was injured in the incident.
