39 Nepalis (see the names below), buying space in Kantipur daily, appeal to leaders of Seven Party Alliance and the Maoist party. This appeal was first published in Nepali in the Sept 21 issue of Kantipur as an advertisement.

Gentlemen,
Before peace and democracy, fought for during the 2006 People’s Movement, have been attained, the country is entering a vortex of human insecurity. The forces that defeated royal authoritarianism by means of the 12-Point Agreement are growing apart, and this provides opportunities for reactionary elements to become active. Steps must be taken immediately to reduce the confusion and mistrust between the seven parliamentary parties and the Nepal Communist Party (Maoist) during the interim period before the elections to the Constituent Assembly. We appeal to the leadership of the eight parties to reach a wide-ranging agreement with regard to a peace settlement before the upcoming Dasain season. In our opinion, once the roadmap for peace is decided upon, the very maturity of the people will lead us through to the Constituent Assembly elections and the new Constitution. We urge the eight parties to put behind them questions of who has or has not conformed to their stated responsibilities thus far, and to move ahead with a new mutual understanding.
In our view, the central focus of the eight parties must be the people of the villages and districts, who are in the process of losing hope and trust. The eight parties must work together in order to create a comprehensive roadmap that will pave the way to both the Constituent Assembly elections and to lasting peace. In our opinion, such an agreement between the parties should include understanding on the following points:
1. The Interim Constitution
Neither the peace process nor the preparation for a Constituent Assembly will move ahead without the incorporation of the Communist Party of Nepal (Maoist) – one of the forces that participated in the April People’s Movement – into the government. The Interim Constitution is required in order to achieve this inclusion, but the recently submitted draft Interim Constitution is incomplete because the parliamentary parties and the CPN (Maoist) were not able to agree on the key issues. Since it has already been agreed that the Constitution for a new Nepal will be created through the Constituent Assembly, an interim constitution should be made through general consensus and in a manner that it does not contradict the proclamations of Parliament.
2. The Interim Parliamentary Order
Since it is the reinstated Parliament that has been able to guarantee the gains of the People’s Movement through its national legitimacy and international acceptability, for now one does not see an alternative to this institution. At the same time, as a group without representation in Parliament, it is not possible for the CPN (Maoist) to be accountable to the House when it is in government. To get around this problem in a practical manner, we suggest that a People’s Consultative Committee be established by agreement between the eight parties. All political decisions would be taken by the Committee, which would be given the stamp of approval by the government and Parliament. The committee must function under the directives of the leaders of all eight parties.
3. Management of Arms
In our understand, the ‘management of arms’ involves, on the one hand, the bringing of the Nepal Army under full control of the government and Parliament and to make it committed to the democratic and pluralistic system of government. On the other hand, ‘management of arms’ refers to, from start to finish, the process of Maoists setting down their arms. It is important to make the officers of the Nepal Army who are implicated in atrocities during the conflict and who were part of the royal takeover to be held accountable for their actions. Meanwhile, at a time when the police and army are confined to their posts and barracks, it is a fact that the people at large in the villages and districts are having to live under the threat of armed Maoist groups, in an environment of fear. Even though guns are not being fired under the ceasefire, the citizens are yet to be freed from the fear of weapons. It is our conviction that the Maoists cannot backtrack from their commitment to management of arms, under the letter and spirit of the 12-point agreement and the 5-point letter to the United Nations. Therefore, in order to afford the people psychological relief, it is necessary that the CPN (Maoist) place all of its armed personnel in specified camps under the supervision of the United Nations. Meanwhile, nationally and internationally, we will have to guard against the possibility of atrocities against Maoist supporters who have been separated from their arms. In our view, it will be timely to implement the suggestion contained in the 5-point letter, to put all armed personnel in cantonments, while putting aside for the time being the question of when the full disarmament of the Maoist fighters and militia is to take place.
4. Ceasefire Agreement
Even though the Maoist’s ceasefire declaration is of the phased kind, it has brought relief to the people. The roadmap to permanent peace, however, requires the Government of Nepal and the CPN (Maoist) to sign a bilateral ceasefire agreement. Such an agreement must contain adequate mechanisms for supervision and mutual communication.
5. Agreement on Human Rights
Given that disregard for human rights lies at the root of the violence and bloodshed that the Nepali people have suffered, it is important that the government and the CPN (Maoist) show commitment to respect the basic principles of human rights and humanitarian law, to sign an agreement on human rights and humanitarian law, and ensure its implementation and enforcement.
6. Public Security
The Nepali people are experiencing insecurity and lack of peace, and the absence of government throughout the country is a matter of utmost concern. The Government of Nepal has failed in its responsibility of delivering human security, and this can be considered disrespect of the mandate of the People’s Movement of 2006. In this context, it is important for the government and the CPN (Maoist) to cooperate in giving the citizens a sense of law and order. Logistical support to the Nepal Police should be enhanced immediately, and there should be a move towards re-establishing police posts all over the country. This is important in providing a sense of rule of law nationwide. Simultaneously, in order to provide a sense of security in the interim period, the government has to proceed with providing the basic elements of human security through the provision of public health, education, essential items, and so on. Both the government and the CPN (Maoist) have to agree that in order to provide security to the people, the police force, administration and the court system have to be activated and made visible throughout the country.
In conclusion,
The Nepali people are today involved in making space so that a group that has been engaged in revolt for more than a decade is able to enter open competitive politics with respect and self-esteem intact. We believe that the character of Nepali society as well as the goodwill and understanding between the CPN (Maoist) and the government provide ample reason for this campaign to succeed. The successful implemenation of the peace roadmap following extensive homework between the parties, we believe, can make Nepal a ‘model country’ in front of the world community. Further, the process that begun with the People’s Movement of 2006 to promote pluralism, democracy and lasting peace will ultimately lead the country at long last towards progress. Through the Constitution that will be drafted by the Constituent Assembly, a people that has been cheated throughout history will at last enjoy respect and prosperity within an inclusive structure of governance. Under this process, the CPN (Maoist) too will convert from a ‘rebel group’ to a responsible national party, gaining the opportunity to serve the people and be part of the exercise to create a New Nepal.
If lasting peace were to be achieved through the points made in this appeal, we believe that Nepal is capable of moving ahead with the constituent assembly process. In doing so, through reasoned discussion, the citizenry will successfully address the many sensitive pending issues in order to introduce a new state structure befitting our soil. We ask the eight parties that have been working together from the 12-point agreement to the 5-point agreement not to underestimate the people’s good sense, and to sign a Understanding for Peace and Democracy, before the upcoming Dasain season. As you thus draft the roadmap that will take us to the Constituent Assembly, we also request you to please keep the interests of the people in the villages and districts foremost in your thoughts.

When our jana Andolan II became successful, many people thought that there would be early solution to the problems of our country. But after five months, we are still discussing whether maoists will lay down the arms or not. If yes, what are the modalities ? In the other hand, GPK and others could not convince the Maoists to allay their fear regarding the use of army’s weapons against them. Maoists are over concious about the army. If the government has already said in the Agreement the army will not be used, the Maoists pretend not to understand or convinced. On the other hand, SPA has the tendency to remain in power for a long time so that their leaders or Ministers would like to enjoy the fruits of power i. e. corruption. In the meantime, NC, UML, NC-D and others are trying to consolidate their respectine parties when they are in power.
The real problem in our country is that the parties do not care about the people’s problems. Maoists are extorting money everyday from earning estabklishments on a regular basis. Now I think, the majority of above listed people are much more concerned to save their own businesses rather than talking about the overall welfare of the people. Some them were the persons who are responsible for praising the Maoists and making the Maoists to this stage.
So we all elite Nepalese particularly the political leaders and society leaders are interested in our self interest rather than the interest of general public.This has been the case from 1990.Majority of these people exploited the Government to make the policy in their at the cost of general public. Now it is a way of shedding crocodile’s tears when it came to the existence of their business.
But anyway, they have realised that though belatedly that if there is no peace in Nepal, theair business and profession can not thrive.
The key problem is the maoist terrorist. They never agree to laid-down guns and bullets. If they agree down to guns and bullets, we will have peace and normal life as used to be before. They are terrorizing and destablizing political process and structures of further development of the country with power of guns and bullets. they have forcefully had captured governing system and threating to all citizen to follow their rules and orders. Now, a member of cabinet is telling that government will feed to those terrorist. It shold be discussed with people.
We people have been going unthinkable economic hardship and mental unbalance due to maoist threat. Who will listen to our pain and suffering?

A person advocating and organizing such murderous violence and provocations against the peace should be imprisoned and tried for violent conspiracy. It is obscene to call for murder and try to solicit a fascist squad to execute people.

“Lay down the arms first and move toward peace and democracy” should be our slogans. What to do to NA and PLA should be left to UN. If we cannot solve that problem then leave to international communities they have all sources and techniques. But our heart should be clean of the devil mind. Arms can be used for the threatened but canot be used all the time, it start to threatened oneself. The global history has already proved it. I don’t see any logic behind maoist that they like to keep arms and arm forces to safegaurd the future democracy. My only question to Prachanda and Baburam is that why Mahatma Gandhi became popular and won the race without arms?

Today, RAW agents Baburam and SD Muni both spoke at the same program in Kathmandu. Baburam praised India for helping them to reach 12 point agreement. So now you knpw who is behind Maoists. Indian govenment’s policy towards Maoists is contradictory. On one hand they declared Maoists as terrorists and on the other, they are openly helping them. Now it is clear.

Lately the Indians through their Embassy has been spending heavily on eduacation in Nepal, I hear they have earmarked 10 arab rupees for it – Great! But wait a minute all this spending or atleast the majority of it is only being done in the Terai regions close to the Indian border. What’s going on dhotis?

The economcy, security forces, political and even social culture are directly tied-up with India, so some reasons are there for making Nepal, Bangladesh and Sri Lanka failure. We are hiding this truth since the establishment of early democracy just for the sake of vested interest. It has been heard that Indin police torched the Nepali village and no one is even asking why they are doing?
Baburam is a sell out. We cannot and should not trust him. He is an absolute Indian poodle. Things are now getting clearer. Makes sense he comes from Nehru University, where he must have been recruited by RAW during his time there. His fight with Prachanda was because of whether to go along with India (Baburam’s idea) or go along with a more and more anti-Indian palace (Prachanda’s idea). Feb. 1 happened which greatly dissapointed Prachanda and the Baburam option was pursued. Otherwise the maoists had no intention to patch up with their No. 1 enemies the SPA contradictory to the belief that the monarchy was their No. 1 enemy before Feb. 1. So the Indian plan was pursued with te SPAM happening. If Feb.1 did not happen there would be no SPAM. I think the Maoists did appraoch the King before Feb. 1 to get in the same team but he obviously had to say No. Probably should have said Yes for greater stability and national sovereignity. Now we are India’s puppets. Call it India bashing or whatever, but these are the hard facts. Personally I have nothing against Indian people, they are doing well and I hope they do better. But facts are facts.

The way the things are- SPA will just walk the walk as per maoist at the prodding of India and hell will break loose. I see no alternative. The best option for SPA is to extend a hand to King and agree to work it out on the basis of 1990 Constitution rather than go for hare-brained idea of Constitution assembly.
The whole thrust by the India has been to create a situation for Constitution Assembly whereby they dictate the out come by utlizing Maoist and SPA- basically, they are pawn in hands of India and they know it.

It has been heard that all the agreement between SPA and maoist are done in Indian prime minister’s office. The only question of the people of today is why India (one of the democractic country) has so much faith toward maoist ideology in Nepal?? It is time again to talk again of protecting ourselves. The Maoists behave in such rampant, undisciplined manner, people beg for protection. The government, with its outside friends, who have words and money but not much else, will not do the first thing demanded of them: protect us.
What the Maoists Call “Peace”
How do the Maoists play the game? We could choose from hundreds of episodes, but let us take only one. On August 27th, a gang of 25 ultra-Maoists – the type who spout the labels they teach the children they kidnap – the words of hatred, the false categories of “oppressed” and “oppressor” – came to Nepal Dairy, Mahaboudha, Kathmandu.
They were armed, as they always are, in violation of the agreements, but they hid the weapons in their bags. But they made sure all knew they were armed. Claiming to represent the Maoist-affiliated trade union, they barged into the kitchen, bakery, and fast food outlet and forced all present to join them in a mass meeting “to empower the workers.” They were arrogant, like criminals, humiliated and insulted one and all, especially the management.
They tried to impose a Maoist trade union on the workers, although virtually all of the staff and workers agreed that such matters were internal concerns of the industry and signed the minutes that the staff could harmoniously work with the management and mutually settle any problems that arose.
This mattered nothing to the Maoists. They are trying by force to establish their union in industries and factories so that they can paralyze the government by closing down business as and when negotiations fail. They have no goal other than to disrupt business and eventually close down businesses when they need to do so to cripple the country.
As the Maoists threatened the workers, they were helpless. A complete failure of law and order meant there was no one to come to the rescue. Management decided to call the Nepal police.
A group of police came, but they also were helpless. Obeying the agreements, they did not have arms! Looking to the fast developing crowd in the courtyard, the Maoist thugs departed.
Temporarily, the problem was solved, but the Maoists vowed retaliation.
This would be only a matter of time, because there is no security, and the government has turned a blind eye to the problem that the industries are facing everyday. The concerned ministers seem more interested in photo opportunities with foreign delegates instead of pragmatically solving problems.
What are we to say when this is the present state of affairs at the grassroots level right in the heart of the capital, Kathmandu? Is it any surprise that businessmen are confused if they should continue to struggle to keep their businesses going?
Nepal Dairy, established in 1980, is the leading private dairy and food processing industry in Nepal. It has four dairy-based fast food outlets and more than 300 affiliated retail outlets. Its total investment is to the tune of 90 millions of Nepali rupees. It has given direct employment to 200 staff and indirectly supported more than 7,000 farm families by procuring milk and other agricultural products.
None of this reality seems to matter in the make-believe world of the Maoists.
Maoist Way of Doing Business
One of the Maoists, as he left, threatened one of the management, saying, “This guy should be wrapped up in a jute Bag” – the way of killing the Maoist thugs have used before, especially in our countryside. They are no different from the Khmer Rouge in Cambodia, who used the same methods.
Following this incident, the owner/operator, Dr. Heramba Rajbhandary, informed the Chief District Officer and the concerned ministry. All the major political parties were informed about the incident informally. After that, Dr. Rajbhandary and son stopped taking calls from outsiders and stayed away from public places.
This did not matter, since on September 16th, the Maoist thugs returned.
Again, it was about 25 Maoists who appeared. They entered the residence of Dr. Rajbhandary in Lalitpur and thrashed him and his son while they were still at bed in the morning. Remaining female family members were helpless. Dr. Rajbhandary is 74!
Nepal Police were present, but they could not stop beating and just watched the incident helplessly. In fact, it was factory workers who came and stopped the attempted abduction of Dr. Rajbhandary and his son.
Dr. Rajbhandary is being treated at Bir Hospital. The Maoists threatened the family members not to release the information to media, but this correspondent has learned the truth from the witnesses.
The workers say there were no problems or issues between management and employees in the company. No staffs had been sacked. Problems such as existed were created by Maoists themselves in their effort to achieve their goal of control over the industry.
Some media have reported differently, but that is the way things are now in Nepal. Many media traffic in lies. I do not need to name them here.
Where does this leave us? Industry is the backbone of the country. Nepal government is not in the position to protect its citizens much less its industries. The Maoist goons have not stopped their extortion, their abductions, and their threats against people who differ with their wild ideas.
In such a situation, what hope is there for the true peace that Nepalis long for so desperately? A Constitutional Assembly can’t be achieved with this type of actions and mentality by the Maoist thugs. Nepali people yearn for a lasting peace and prosperity in the country, not the imposed “peace” that the criminals have brought to our homes.
There are only several options in such circumstances.
If the Maoists want peace, their leaders must use their disciplined members to end the reign of terror being inflicted on us by the criminal elements.
If they will not do this, then the Nepal Police must again carry weapons and must be supported by the Armed Police Force and the NA.
If none of them will do this, then the people must organize and arm themselves.
“All power to the soviets,” claimed the Maoist god, Lenin. Are the Maoists so foolish not to see that we, the businesses and the workers, are the “soviets”?
It is time for Nepalis to fight back. If our government will not protect us, we must protect ourselves.

Here’s a question for SPA leaders to answer: “Are SPA district level cadre even allowed to hold rallies/meetings on their own accord or do they still need permission from their Maoist bosses? Because here’s irrefutible evidence of the Maoists holding “meetings” at their will, on the SPA’s turf.”

At a minimum, launch an investigation and track down the goons in camouflage. Three faces are crystal clear in this image itself.
Obtain testimony from any number of seated individuals and then proceed to issue warrants for the arrest of those conducting the indoctrination (intimidation/unionisation) session.
All those who work to guarantee human rights in Nepal should work double-time to guarantee that no harm comes to any of the victims of this gross violation.
Send e-mails/letters/faxes to every human rights organization operating in Nepal, regionally and internationally, to appraise them of what is happening in Nepal.

If no action is taken to apprehend, question and if found guilty, jail the guilty parties in the image above, demand resignations starting from the top of the chain of command – First Krishna Sitaula, then the Chief of Police and moving down the ladder.
No one has the right to violate anyone else’s rights. This is the most FUNDAMENTAL human right.

As for building a Church inside Pashupatinath Area- th real intention is to flare up secterian violence, don’t think its not by design. But when push comes to shove, we Hindu (liberal religion) will do whatever is necessary. If someone makes us what we do not want to be then so be it.
Also we demand a Hindu autonomous region as the country is no more a Hindu state.
Church inside Pashupatinath is an insult to all Hindus. We have nothing against other religions but people should not dare encroach on our religioin as well. Are we allowed to build temples in the St. Peter’s square in the Vatican or in Mecca? If people try to be insensitive to this issue we will begin Mahabharat part 2.
