King's Deceptive Message

The much awaited address by king has only solidified his ambition to remain in power.

In his 5 minute long speech, king has tried to take credit for his direct rule and seems reluctant to give power to the people. He has cited article 35 of 1990’s constitution and asked SPA leaders to come up with a name of Prime Minister. Until such name is fixed, the king has declared that he is clinging to the power.This is an utter deception. He is not willing to give up the power yet. This is only a cosmetic change and no one should believe in his words.

It is done only to manage the growing international pressure upon him. He should have cited article 128 by which a powerful PM could be appointed. He is not ready to bring the Maoist in mainstream politics which is the major concern of the people. He should have asked SPA to form an interim government that will eventually hold election for unconditional Constituent Assembly.

People sloganeering in the streets have voiced their concerns over kings deceptive steps.

Meanwhile, state has extended curfew from 8pm to 12 o’clock.

Rajendra Pande, central member of CPN (UML) says : This is a treachery. The movement will go on unless power is handed over to the people.

Upper House MP and lawyer Radheshyam Adhikari comments: This so called solution can not stop people from reaching their goal of loktantra.

Proclamation to the Nation from His Majesty King Gyanendra Bir Bikram Shah Dev
7(21 April 2006)

Beloved Countrymen,

You are all aware that, given the situation prevailing in the country then, we were compelled to take the decision of 1 February 2005 to set in motion a meaningful exercise in multiparty democracy by activating all elected bodies, ensuring peace and security and a corruption-free good governance through the collective wisdom, understanding and the united efforts of all the Nepalese. By supporting our decision, the Nepalese people made amply clear their desire for peace and democracy and the civil servants demonstrated sincerity towards their duties. We are appreciative of this. We also have high regard for the dutifulness, valour and discipline displayed by the security personnel, upholding their glorious traditions.

By visiting different parts of the country, we made honest endeavours to acquaint ourselves with the hopes and aspirations of our people, mitigate their hardships and boost their morale. We also called on the political parties to enter into a dialogue in the interest of the nation and people afflicted by violence and terrorism. However, this did not materialise. The ideals of democracy can be realised only through the active participation of political parties. In keeping with the traditions of the Shah Dynasty to reign in accordance with the popular will in the greater interest of the nation and people and our unflinching commitment towards Constitutional Monarchy and multiparty democracy, we, through this Proclamation, affirm that the Executive Power of the Kingdom of Nepal, which was in our safekeeping, shall, from this day, be returned to the people and be exercised in accordance with Article 35 of the Constitution of the Kingdom of Nepal – 1990. As the source of Sovereign Authority is inherent in the people, harmony and understanding must be preserved in the interest of the nation and people in an environment of peace and security. While safeguarding multiparty democracy, the nation must be taken ahead along the road of peace and prosperity by bringing into the democratic mainstream those who have deviated from the constitutional path. Similarly, a meaningful exercise in democracy must be ensured with the activation of representative bodies through elections as soon as possible. We, therefore, call upon the Seven Party Alliance to recommend a name, for the post of Prime Minister, at the earliest for the constitution of the Council of Ministers which will bear the responsibility of governing the country in accordance with the Constitution of the Kingdom of Nepal – 1990. The present Council of Ministers will continue to function until the appointment of the Prime Minister.

    Just forming of Next Government is no solution……….we want revolution here and such a process that even the parliament can remove king if it ratifies by 2/3 majority.In Bhutan, just new formed but yet to implement Constitution says that U can remove king if parliament passes such proposal by 2/3 majority………We want new Constitution and we want such provision.

    BetterNepal, lots of us believe that the ‘power of the people’ has NOT remotely gone back to the people.

    And until it really has, I doubt there’s going to be much progress. It would be kind of painful to have the entire news stations all over the world laugh at the Nepalese 😦

    People who are charmed by Sher Bdr Deuba: Mind that it was him who dissolved parliament under KG’s ‘matiyaar”. And he has not been happy about SPA 12 point agreement with MB. Sher cannot address MB issue. Sher won’t be appropriate even if SPA go ahead and follow KG’s instrunction.

    The choices are:

    1) Reject it outright.
    Pros: It may be faster
    We will be reaching the goal outright
    Cons: More blodshed
    Chances of losing momentum of the movement

    2) Take it and bargain for more power

    Pros: Less bloodshed
    Will be supported by international community

    Cons: Goals not achieved yet
    Long, slow process of bargaining and will require a lot of manuvering
    Gyane might create division within SPA, and take back power
    More uncertainty

    The King has taken this decision based on consultation with India and US. Therefore we can assume that this solution is acceptable to them. Now, if the SPA wants to go against the wishes of international communities, then good luck to them.

    Why did not KG addresses the issues raised by Maoist and civil society. Why the authentic comments of SPA, Maoist has not yet come? Are they still thinking the King is favouring them?Don’t believe on “Gharla ra Khaula”. If this happen again the people will throw you in rubish bin.

    Let us be realistic guys. It seems as if many people dont even know anything about Nepal.

    Get out of your computer chairs and see the reality of Nepal, see how it is see who have represented people, who are the parliamenterains.

    Who called the demonstrations and what should be done to restore democracy and peace?

    Let us be realistic, let us not act like children and suggest names of Gagan Thapa ( who plundered in name of students at TC- 1 number durbar ko dalal) and corrupt people like Narahar Acharya (ex-darbariya).

    In order for justice and system to prevail in country, SPA shoud form the government ASAP headed by Sher Bahadur Deuba.

    This proves that these SPA are not easily going to submit to the Shahi Terrorists. Andolan should rise like tsunami and sweep away these all Democracy haters like Paras and KG.
    There is nothing new in KG’s Speech. He is still proud for what he did in Feb 1. That shows that he can do the same again and again when he wants. That is not Democracy to us. He must know that Rule of law is sine qua non to Democracy.

    Article 35 of the Constitution. Executive Power:

    (1) The executive power of the Kingdom of Nepal shall, pursuant to this Constitution and other laws, be vested in His Majesty and the Council of Ministers.

    (2) Except as otherwise expressly provided as to be exercised exclusively by His Majesty or at His discretion or on the recommendation of any institution or official, the powers of His Majesty under this Constitution shall be exercised upon the recommendation and advice and with the consent of the Council of Ministers. Such recommendation, advice and consent shall be submitted through the Prime Minister.

    (3) The responsibility of issuing general directives, controlling and regulating the administration of the Kingdom of Nepal shall, subject to this Constitution and other laws, lie in the Council of Ministers.

    (4) Except in so far as any action is to be taken in the name of His Majesty pursuant to this Constitution and other laws, all other executive actions shall be expressed to be taken in the name of His Majesty’s Government.

    (5) Any decision, order or implementation warrant to be issued in the name of His Majesty pursuant to this Constitution and other laws shall be authenticated in such manner as may be set forth in rules made by His Majesty at His discretion. All other decisions, orders and implementation warrants to be issued in the name of the Council of Ministers pursuant to clause (4) above shall be authenticated in such manner as may be set forth in rules approved by His Majesty.

    (6) No question shall be raised in any court as to whether or not any recommendation or advice has been given to His Majesty pursuant to this Constitution by the Council of Ministers or any other institution or official, nor shall any question be raised in any court about what recommendation or advice has been given.

    PART 21
    TRANSITIONAL PROVISIONS
    128. Provisions Regarding The Council of Ministers:
    (1) The Council of Ministers existing at the commencement of this Constitution shall be deemed to have been constituted under this Constitution.
    (2) If, for any reason the Council of Ministers referred to in clause (1) is dissolved, His Majesty shall constitute a new Council of Ministers consisting of representatives from the main political parties.
    (3) A Council of Ministers constituted under clause (2) above shall consist of a Prime Minister and, on his recommendation, other Ministers, State Ministers and Assistant Ministers as may be required.

    U can read Article 35 above. It does not make any sense at this point of time about Article 35 because KG and his followers have raped Old Constitution so badly from all the (loop)holes that it became non-functional. There is no compromise on People’s democracy and its power.

    As you can see the 1992 Constitution has a lot of potentially conflicting things, as it was drawn when King was bargaining for lots of executive power. Next step is surely a Ceremonial (or NO) king, AND CA. This will solve ALL problems.

    Believe me, if I was in Nepal, I would be there. And I agree with Candie, I have a lot of respect for those who went to protest, leaving their comfortable middle class homes and risking their lives.

    But that risk will be worth absolutely nothing if the king is allowed to be a king. I value those people’s lives too much to let them have risked it for nothing. Just so the despot king could wake up in his comfy jammies in Narayanhiti the next day to munch on donuts and watch TV.

    And Sher Bahadur Deuba’s wife, Arju Rana is related to Gyanendra so I can see why Mr. G would want Deuba to be PM. And Arju Rana of course, inherited mucho $$$ from her Rana family. The $$$ that the Ranas had stolen from tortured, raped, murdered people.

    The people of Nepal in my opinion, have been getting screwed over by the Shah/Rana hybrids for a long time. (Add koirala, and k bhattarai to that).

    A British historian dude showed up on BBC and was saying that the monarchy was finished. Gyanendra will be exiled to India because he’s done too little too late.

    Where are you hiding still? Why we did not get your comment on King’s deceptive message? Do you have difficulties positioning your stand in connection of royal trecheraous proclamation? King will again get doubt of benefit if you start arguing on his deceptive message. Isn’t it crystal clear KG still wants to remain in power? Deuba may come with greedy desire, if so kick him out from SPA .

    I was in Assi Ghat Sharma with Anup and Dipti Ranjan Mishra, when I came to know that the king who is also the chairman of the Nepali government was going to address today at 7:00 NST.

    Actually, a boadman was listening the news broadcast by an Indian radio channel. The news read was talking about Karan Singh’s briefing and his recent visit to Nepal, and the demonstration in Nepal against the King. Meanwhile, it said that the King would address the nation. So we rushed to Lanka.

    After eating Idlies in a restaurant just opposite of this cybercafe, I and Anup entered here.

    I first opened ekantipur and nepalnews. There was only mention of the “address.” The bbc site posted nice reporting from Kathmandu.

    After waiting for many minutes, the king’s speech has been has been published by nepalnews.

    I did not feel that I read the whole stuff. But for me still it appears that the king is only trying to save his throne.

    The very king and his company who have always used bitter words for the leaders who resorted to the foreign support for the fight against autocracy seems to be kneeling down to the Indian government’s pressure.

    Shame!

    Couldn’t he say earlier that the executive lies in the people? Or, is he only trying to obey what his indian masters have ordered?

    Why did he wait for Karan SIngh?

    Why did the Indian goverment send Karan SIngh who is cousin of the Nepali autocrat?

    Something is fishy.

    This is powerplay again. The Indian government and the Nepali Royal Place are only looking after their vested interests, it appears so. They do not have to do with the democracy and people’s desire. If not so, why the double standard?

    The political parties, particularly, the Seven Party Alliance should understand this and should not give up what they are doing now.

    Yes, people have been suffering from the general strike and the curfew imposed by the goverment. Personally speaking, I too have bee stuck here in India. I am practically broke now. But I don’t care if the demcracy gets established.

    Let’s see what would happen next.

    We are in a very decisive situation in the history of nepal now.Right now we are having half an hour of black out, the only thing that is brightning up by room is the light from the computer screen.
    King has been very meticulous at usage of words ..Just .listen to its Nepali Version. Look at how he uses words like “Naaso”.
    The SPA and People in the street has to be very cautios now . How many more days can demonstration be possible ?? A sinlge Lemon has now been bought for 11 rupees can u imagine that ? what shall be the situtaion if we keep on doing andolan for 15 more days? Will my employer give me salary of the month of April ? Will govt. Emlyoyees get thier Salary if things keep on running this way ??
    I m not at all trying to demoralise the peoples movement, but how many days can this andolan carry on!! The king is not going to call it off. Until RNA is supporting the king we can never have a republic lets face it .How many more people to die for the country ??? I am worried and frustrated with all this . Its just my observation and questions … WHat will happen to NEPAL ??????????????

    How soon before even the army gets pissed off? That’s the question. Its good the U.N is tightening the noose. Something has to be done to make the Army understand the consequences of supporting the ‘King’. In time they’ll understand. Once they don’t get those jobs, once they don’t have the money to buy the ammo.

    Who knows? Insight might come faster. They saw the crowds. 200,000 here, 80,000 here, 50,000 here. They can’t be fool enough not to realize that no one wants their ‘King’ around anymore. Numbers, numbers, they make an impression.

    I don’t know if people will keep the agitations up. Surely there will be more deaths. But if they’re kept up, the army will crack. That’s the power of a popular movement.

    What if we have a PM appointed by the seven parties and then he appoints the council of ministers and still is under the king who will still be the constitutional monarch? Do we, or do we not want a country free of this idiot king who seems to keep on taking control of power time and again. Then we have another situation where we face the fact,about who will be, the next PM? We are aware of the fact, that once we make provision for the parties to take over power, they do change their colour. SO, now its upto us to decide, do we settle for something less even after loosing so many valuable lives, or do we continue and get what we really want and what those people who dies for really wanted?

    Guys, lets look at this situation in this way, the parties go to the power, arrange for an election to a constituent assembly, we vote for a republic and so finally Gyanendra goes. This method could be very peaceful, our economy won’t suffer and what’s more it will all be done within the spirit of democracy.
    Or rather we could make Gyanendra himself declare that he is abdicating the throne, but that won’t happen without a huge bloodbath and an irreversible damage to the economy.
    Choose your option guys.
