Maoist Comrades, Please Respect the Code of Conduct

As Nepal is going through the tumultuous peace process, Maoists are winning in the competition to violate the code of conduct of the cease fire. The government is lagging behind in bringing its perspective on the widely awaited high level summit with the rebels. Here are a few headlines that tell us about the Maoist activities that are against the theme of the peace process:

1. Maoists Abduct Five Civilians

ROLPA, Sept 6 – Maoist rebels on Wednesday abducted five civilians affiliated with the Rolpa Drinking Water Project.
The rebels said they abducted the five on grounds of “spending the VDC’s budget for the project without informing them (the Maoists).”

Those abducted were identified as Nanda Prasad Oli, Som Prasad Khatri and Puran Bahadur Oli of Jankot VDC-9 and Kewal Prasad Oli and Bishwo Dagi of Jankot VDC-6 in Rolpa district. According to family sources of the abductees, the Maoists have refused to release them until the amount spent on the drinking water project is handed over to them.

Meanwhile, the National Human Rights Commission office at Rolpa, has requested the rebels for the unconditional release of those abducted. An official at the Commission’s contact office Balkrishna Pokharel requested the Maoists to respect citizen’s right to life urging them to defend the International Humanitarian Laws and human rights. 2. Youths, transport entrepreneurs protest Maoist ‘excesses’

JANAKPUR, Sept 7 – Angry youths protesting against Maoists’ “excesses” shut down the Janakpur bazaar on Thursday after the rebels forcefully took a motorcycle from a local.
Similarly, the transport entrepreneurs in Janakpur today brought the public transportation in the region to a halt against the Maoist excesses since this morning.

The protest flared up after deputy chief of the Maoist “people’s government”, Sadhu Yadav allegedly tried to abduct chairman of Janakpur Bus Entrepreneurs’ Association, Shyam Chaudhary yesterday evening, said sources. According to the association’s vice chairman Jeet Narayan Chaudhary, a scuffle had erupted between the bus entrepreneurs and the Maoists after Yadav, in an attempt to disrupt the association’s elections, tried to abduct chairman Chaudhary.

Angry youths carried a procession around the city chanting slogans against the Maoists at Janakpur following the incident. The bus entrepreneurs have said despite a day’s closure spelling a loss of Rs 1 million they will continue their protest oblivious to the financial loss until the Maoists put a stop to such activities.

Meanwhile, claiming that students and teachers vandalised over a dozen microbuses in connection with a highway mishap, the Eastern Region Microbus Entrepreneurs’ Association halted the traffic on all routes going east from Itahari today. Issuing a press release today the association attributed the closure to the vandalism by the students and teachers that damaged property in millions following the incident in which a girl student was struck by a micro bus bound for Biratnagar from Kakadbhitta, Jhapa.

The victim, Sabina Shrestha, 15, is undergoing treatment in Siliguri, India. In addition, downtown Kakarbhitta remained tense following the vandalism at the Kakadbhitta Campus by local microbus workers. In response, irate students carried a procession around the city chanting slogans.

According to the police, four involved in the vandalism have been taken into custody. The lack of public transport vehicles has crippled life in the region. Meanwhile, a joint meeting of the entrepreneurs, students, civil society, and political parties to defuse the situation is underway at the District Administration Office. (source)

3. ISG Condemns Maoist activities

KATHMANDU, Sept 7 – The Industrial Security Group (ISG), which brings together concerned Embassies, bilateral Chambers of Commerce and industry associations, met on Sept 5 to discuss the deteriorating law and order situation in Nepal, said a statement issued by the American Center in Kathmandu on Thursday.

The ISG noted with concern the many reports of increased Maoist extortion and threats made to employees, employers and entrepreneurs engaged in commercial, industrial and tourism activities since the government and Maoist cease-fires were announced, the statement said, adding, “These activities have intensified despite the Maoists’ commitment to cease them.”

Maoist extortion demands, coupled with aggressive efforts by the Maoists to intimidate employees into joining Maoist unions, are pushing enterprises toward bankruptcy and putting entire sectors of Nepal’s economy at risk. Maoist demands threaten to cripple Nepal’s struggling economy, the statement further said.

Urging the Maoists to immediately end all such activities, ISG said such activities are in direct violation of commitments they have made to the Seven Party Alliance, the Government of Nepal, and the people of Nepal. “These actions contravene international human rights standards. They are also incompatible with the Maoists’ stated aspirations to join the democratic process.”

The ISG also strongly urged the Government of Nepal to take immediate steps to restore law and order and to end Maoist intimidation, forced unionization and extortion. The Industrial Security Group comprises representatives of the Embassies of France, Germany, India, the United Kingdom, the United States and the Delegation of the European Commission, along with bilateral Chambers of Commerce and industry associations. 4. Rebels ‘chase’ protesting cabbies

KATHMANDU, Sept 6 – Members of the Maoist affiliated All Nepal Trade Union Federation (ANTUF) on Wednesday morning “chased” away taxi drivers who were obstructing city roads in various parts of the capital. At least two dozens taxis were vandalized as protesting cabbies initially refused to comply with the Maoist cadres’ “request’” to clear the roads. Cabbies said the Maoist group also beat up a few of them while removing taxis parked haphazardly on the roads.

According to Nepal Taxi Drivers Union (NTDU), the Maoist group vandalized at least six taxis at Sinamangal, 10 at Chabahil Chowk, two at Kalanki and six more at Sorhakhutte area Wednesday morning. Vehicular movement along city roads returned to normal in the afternoon. NTDU, along with three others transport organizations, had called a strike in Kathmandu Valley on Wednesday protesting against the killing of cabbie Chuda Mani Thapa at Koteshwor, near Sankhmul area. Thapa, who hailed from Doramba, Ramechhap, was killed by unidentified armed assailants Monday night. The strike was called after authorities failed to provide Rs 500,000 compensation to the family of the deceased.

Vice-President of ANTUF Badri Prasad Bajgain said they had “mobilized” volunteers in different parts of the city to clear the obstructed roads in the morning. He, however, refuted reports that ANTUF cadres vandalized taxis in their attempt to clear the streets. Maoist cadres were mobilized to clear road obstructions since ANTUF had organized a mass meeting in Kathmandu to celebrate their fourth general convention today.

“We were forced to call off the protest Wednesday afternoon following pressure from Maoists and civil society members,” said Sita Ram Khatri, president of NTDU. He said that they would stage a transport jam at six various places in the capital for one hour starting 9 am on Thursday and Friday. The places include Sinamangal, Koteshwor, Chabahil, Balaju, Kalanki and Lagankhel. “We will be forced to announce a general strike in the valley if authorities fail to meet our demands by Friday,” said Khatri. 5. NEA opens counter despite Maoist interference

SURKHET, Sept 6 – Nepal Electricity Authority in Surkhet, which closed its cash counter on Tuesday due to Maoist pressure, resumed collecting payments from its customers Wednesday, after heavy deployment of policemen at the office. However, only few people came to pay their bills, because of a “tense” situation between Maoist cadres and policemen outside the NEA office, a local said. In spite of the heavy presence of policemen from early morning, a Maoist cadre entered inside the NEA office and demanded 50 percent of the collections, a NEA employee said. “He (Maoist cadre) could not take the money as policemen came in immediately,” he added. Eyewitnesses also reported a scuffle between policemen and a Maoist cadre outside the office.

Meanwhile, the cash counter of the Nepal Telecom here remained closed on Wednesday. “The office is being closed due to technical problems in online computers,” a notice outside the NT office said. A Maoist cadre kept vigil outside the office gate throughout the day, eyewitnesses said. The Maoists have deployed its cadres outside the NEA and NT offices here since the last two days demanding 50 percent of the collections on electricity and telephone bills for the rebel outfit.     On Pushpa, Baburam and the 8AM Maoist Broadcast
    • The Maoists are slowly tacking control of FM Stations in Nepal.
    • They are forcing F.M. radio stations to broadcast news about their political activities. Those not complying or exhibiting reluctance, are threatened with dire consequences.
    • One FM radio station, Ghoda Ghodi in Bardiya district has been forced to close because it did not comply with Maoist demands.
    • In other cases, it is believed that the Maoists and FM station operators have reached a mutual understanding. The rebels have assured FM Stations of payment for their service. As per the understanding, the Maoists will not let employees of the FM stations stage protests or strikes in future and they will not ask for any donation from FM Stations. From the sounds of this, it appears the Maoists have engineered a complicated strategy of payments in return for services – similar to the protection / insurance schemes that Mafia organizations get their revenue from.
    • The Maoists have issued stern verbal and written warnings to government owned TV and radio stations also.

    • It is rumored that Maoists leader Prachanda has instructed his cadres to be ready to take-over the Katmandu valley.
    • According to reliable sources, the American Embassy, Singha Durbar, Telecommunications Offices and Security barracks are cited on the Maoists list of assets to control.
    • It is also rumored that 30 vehicles of the Maoists entered the Katmandu Valley on 2nd and 3rd of September, 2006, with logistics necessary to engineer the takeover.
    • Commander of the operation, Nanda Kishore Pun a.k.a. Pasang has surfaced publicly in Kathmandu last week.
    • It is also rumored that Pasang has studied “Guests of the Ayatollah” in detail – he intends to use this strategy to overwhelm the American embassy in maharajgunj.

    On Protests by the Relatives of the Disappeared
    • A protest rally in Katmandu is being organized by the families of those allegedly disappeared by the state.
    • The demonstration is being mobilized and led by the Maoists. Those, not biased, are asking questions why families of more than 300 people disappeared by Maoists are not organizing a similar rally.
    • Last week Maoists abducted and then killed a pregnant woman. People suffering from Maoists atrocities have labeled charges against so-called Human Rights activists as being champions of the Maoists cause.
    • The relation between these events – if killing a pregnant woman is not a problem for the Maoists, they will surely not hesitate to kill protesters who demand to know what happened to their kin, in Maoist custody. There is also the memory of what the Maoists did to the leaders of the Maoist Victims Association.

    Internally displaced people blame this government for not being able to enforce their agreements with the Maoists. After all, these are clear violations of the code of conduct that the Maoists blame the government for violating, almost every day. IDPs largely charge Home Minister Krishna Prasad Sitaula as a person with three roles – Home Minister, Chief Government Negotiator and Spokesperson for the Maoists inside the HoR.

    Whatever is happening in Nepal is India’s strategy of breaking it to peieces and swallowing it. Through maoists, they have started Federal Structure of Nepal on the basis of race like Khumbuban Region, Magarat, Tamu Region, Madhesi pradesh, Newar etc. These races will fight each other for the resources of the country. Some will also try for the independence and Nepal will be at least broken into 6/7 pieces. The for India it is easier to take Nepal. That is the strategy taught by RAW to Maoists leaders like Baburam in New Delhi.

    Actually, we are all Nepalese first and Newar, Bahun, Kirat and magar afterwards. We have to keep our unity to face these challenges from Maoists fools.

    The federal system touted by the Maobadis that is aligned with an ethnic groups of Nepal is a recipe for disaster. We so far have ethic harmony in Nepal, we do not require ethnic based federated system. Maobadis have used the loose federation with these ethnic based liberation fronts to further their own self-interest.

    Ethnic based federal system that is born amidst the socio-economic & political unevenness due to the historical & religious discrimination will only lead to further fragmentation of the Nepal. We will be back at square one, ie, of 24 fiefdoms (Chobishe Rajyas) constantly squabbling.

    In a country, where the ruling elites have always come from the upper castes & where the historical puritanical divison of the “Matwalis” vs “Non Matwalis” have created institutionalized caste discrimination, the “exploited or marginalized” ethnic groups, eg, the Magars, Tamangs, Kirats, Tharus, Madhesis will seek redemption. This could lead to ethnic cleansing. This is dangerous path for Nepal.

    Ethnic based federal system could lead to a Bosnia & the Balkans style of ethnic cleansing & hatred that will make the Maobadi revolution look like a child’s play.

    A federal system needs to be based upon geographical area rather than ethnic based. A federal system’s goal is decentralization, ie, giving power back to the people. There needs to be a balance of power between the union, region & local level.

    At the Union level, a central government if formed. At a Regional level, a regional government is formed & at the Local level, a local government is formed who have the right to tax & form their own policies, rules & regulations as long as it does not contradict the Consititution & Federal laws.

    This means at a local level, all the people can participate in their VDC or Municipality if they choose to do so. The Local level can tax and spend their revenue as per needs & wants of the locals. This continues at the Regional & then to the Central level.

    Therefore, a federal system is giving control of the government back to the people in a fair & balanced manner, not, to any particular ethnic group.

    Besides, Nepal is such a tiny country to even consider a federated system which will create layers of unwanted bureaucracy.

    And Mr. Wagle what are you trying to do. “oh please, maoists, please, please, i request you to respect the code of conduct. Please do not extort money, please do not kill innocent civilians, please do not abduct innocent civilians……”

    What kind of a peoples war is this? They only kill the innocent civilians. THey avoid foreigners, diplomats, politicians, human right activists, civil society members but just kill, torture, abduct, extort the people they claim to be fighting for.

    Maoists are terrorist. PERIOD.
    Their intention is bad. They will rule with the power of guns. They will never win people’s support instead they will make the people support them with the power of guns. The only way to stop them is to either arrest the leaders or assasinate the leaders and mobile the Nepal Army and their weapons. We need to finish them off otherwise the biggest disaster will arrive when industries will shut down. Businesses will collapse. Good people will leave the country and there will be lootings, killing and abductions. The name of our nation will forever be deleted from the map. International support will discontinue, the left over people will suffer in their hands.

    Many royalist bugs are seemed to be happy by this particular post. No problem because UWB has correctly pointed out the misdeeds of the Maoists and I agree that these activities of Maoists are not helpful to the peace process.

    But what I couldn’t understand is some of the commentators trying to relate this post with DW’s previous posts that are critical to Gyanendra Shah and saying in such a tone like: “look, what you Maoists have done where as you always run after the king.” It’s very necessary to keep track of the king and Maoists side by side. For me, Wagle isn’t a Maoist and he definitely wants Nepal get rid of Monarchy. He is either congress or CPN UML but he has never revealed that. So I can say he is a progressive democrat. I have no problem with his point of view as long as he points out the misdeeds of both the royalists and Maoists in Nepal.

    Many of the acts of Maoists are fit to be branded as terrorist acts but now they are partner in peace. We should understand this fact. Royalists are trying to push Maoists too far so that this fragile peace process could be derailed and they could get an opportunity to celebrate the failure of democratic government. They desperately want to break this peace process. Be careful!

    I was surprised to read an article by Nishchal Nath Pandey, son of notorious Ramesh Nath, former foreign minister in Nepalnews.com. The father and son duo were the ones who took the nose dive turn in the foreign policy and took MOFA to nadir during their reign. It was like their personal property: both foreign policy and MOFA.His views in the article is not also of any values. He is speaking against the democratisation of foreign policy.Why the rayamajhi commission did not call this Mandale’s son for interrogaion on irregularities of funds.

    This means that Mandales are trying to make a comeback. Be careful guys.

    In one interview with Indra Lohani on Kantipur Bahas on Friday, Sept 8, 2006, Lohani asked Maoist Supremo Prachanda about the attrocities conducted by the Maoist cadres. In reply to the question, Prachanda answered saying that their party has become a party for every one in course of time and as a result there are people of all sorts – these people carry on such activities that are against the party policies.

    It might be true, or wrong. But we should also understand that only if there is a sense of tolerance and forgiveness towards all, especially to the Maoists, then it might be possible to bring them to the mainstream politics. If things go like GP koirala is doing, putting conditions for little things, then this is clear that there is no interest in new Nepal.

    Kirat, no matter what you say, blaming an entire country, religion, race, cast or community is not the solution. You yourself accept that it the majority and not all of them. So, there were a few innocent ones and they should not be blamed for atrocities of the majority. I hope you understand. Just becuase people have been doing it in our histroy (blaming the entire community or so on) does not make it right.

    Your example is’nt very good and is completely misleading, infact incorrect. Most people are pacifists, and probably would not fight against dictators and totalitarianism, as most likely they would be slaughtered by the likes of people like Hitler. Mao killed 70 million of his people for protesting, the Khmer Rouge millions, most for not even protesting. I doubt you believe that all muslims support or sympathise with Al Qaeda, but most don’t protest, it does not mean they support them either. Do you actually believe that the majority of Nepalese support the maoists? I doubt it, but where are the large protests against them? How about Sadam Hussein – are you suggesting that the majority of Iraqi’s supported him, or were they just going about their business and life and did not protest because they would be probably be killed, and as most people are pacifists what good would a dead father or mother be to their children?
    I am afraid the majority in many cases do not support such facisism and extremism, keeping quiet about it does not mean support. When was the last time you were on the streets protesting anything leave alone protesting against dangerous and murderous dictators?

    Very true. But to add to that more times than not dictators and totalitarians may have begun their career with good propoganda to get in power – Hitler,Lenin, Stalin, Castro, Khmer Rouge, Prachanda potentially et al. But once in power they use their power and position and the resources and arms of the state to consolidate their dictatorship, by then it would also be too late for even the firebrand protestors to make any effective protests against them. With the help of the state machinery and their own people in power positions they would have established a totalitarian regime to do as they please whereby even if their own citizens in the majority may not agree with them, not much can be done to stop them. It took World War 2 to stop Hitler – but what a lot we lost in the process. So yes, most people are pacifists and even if some are’nt it would be too late as the actor will have become the dictator by fooling the citizens.

    One more issue with regard to your Hitler example, most of the jews murdered by Hitler amongst the 6 million were also German, most of them did not protest when Hitler took power. Neither did most of the Poles, French, etc. when he literally walked into these countries. Proves your point about most humans being pacifists.
    Infact only when Winston Churchill took office as the PM, the British gave lead to end this inhuman injustice, before Churchill the British goverment were reluctant to act.

    B, I think you are getting lost in semantics. When I blame Germans for Hitler I don’t mean every single German that lived in Germany during that time. I mean the majority with whose support he came to power. It is a historical fact that a majority of the Germans did support Hitler during his rise to power (and right from the beginning Hitler was very clear about his racist teutonic bull and hatred for Jews). Just like the white apartheid govt. in South Africa. The apartheid govt. was there because the majority of the whites supported it. An deniable fact.

    Your always on the defensive when people enlighten you with facts.
    However, is one liner attacks on individuals by calling them “ignorant” all you have or do you sometimes actually bother attempting to find an argument in some corner of your brain that you are struggling to access?
    I think you’re the same guy who I have run into before and your arguments always seem to dissolve into name calling when you run out of anything that resembles average IQ.

    st, don’t be bitter. Look if you can’t agree with a simple established fact like the majority of the Germans (during that time) supporting Hitler (during his ascendancy)or the majority of the whites supporting their apartheid govt. in S. Africa then there is very little room for any intelligent argument with you.

    By the way I just realised passive people are so useless that they just don’t count, do they? Whether they get a Prachanda, KG, GPK or a donkey for their leader I guess ‘passive’ people will just go with the flow! After all they are ‘passive’.

    Of course these people (not all, some came through the army and military coups) were probably popular in the beginning, but people don’t know then that they will turn into dictators do they? They are’nt dictators to begin with. When Hitler spoke against the monopolisation of businesses by jews, most of the population probably thought that maybe the jews were unfair in business practices and some sort of check and balance had to be placed just like when the maoists talk of “feudal elements” most ignorant people think – yeah maybe they have a point and some sort of check and balance needs to be placed – most don’t think – Hitler’s going to murder 6 million jews, wow let’s vote him in (which Hitler did after gaining absolute power) OR let’s vote Prachanda in because he will slaughter all “feudal elements”, which he will probably do if he achieves absolute power – thus he becomes a facist dictator well after the ignorant majority realise it. Why is this so difficult for some people to understand?

    I don’t think you have read my comments. The process of becomming Hitler the facist dictator is not something that occurs overnight. I have said people may vote in dictators, but only unknowingly. If you cannot understand this process of cause and effect, just drop the argument. And the plain facts are that most people are pacifists NOT “passive” as you suggest which means something completely different. What would you call yourself – a firebrand revolutionary?

    hey gpk, I get you man but c’mon how many Germans protested when Hitler started coralling the Jews into Jews only quarters, made them wear arm bands to identify themselves (much before he started murdering them)? Why was that acceptable to the majority of the Germans? Should they not be faulted for allowing that to happen in their own land?

    The comparison with Prachanda is slightly different. I will bet you my last rupee if the govt. security forces had countered the insurgency more professionally instead of torturing, murdering, raping etc (same as the Maoists) the very villagers they were supposed to protect then Prachanda/Baburam and his cronies would have been chased out a long time ago. What’s a poor villager to do-the Army/Police comes over and terrorizes him, the Maoists come and terrorize him too-but where the Maoists were clever was at least they offered him a way out by saying ‘join us’ and then no need to fear us. The State offered no such solution.

    Look I hate the Maoists as much as most of you guys. All I am saying is that we should learn from our mistakes in letting them become such a powerful force. Comprendo?

    st, I read your comments. Hitler spelt out his political and racial philosophy right from the beginning. You didn’need brains to figure out that the apartheid S. African govt. was wrong. Besides if we suscribe to your thinking we might as well never trust anyone enough to make them our leader.

    Being pacifist against people like Hitler was plain wrong!

    I agree that the maoists would be history if the armed forced conducted themselves better, even if they did not defeat them, just being civilised with the people they were supposed to fight for would be enough as the people would inevitably do the chasing out for them.
    I can see what you mean by German’s should have protested. I am also a believer that if the civil society want they can achieve alot, Rawanda is a case in point where many of the Hutus though not in support of the genocide were just observers, maybe it would be different if they said No to the murderers from the get go. However, reality is that most people for some reason are like this, look at Nepalis today, we know the maoists are up to no good and yet none of us go out in masses to protest their atrocities. Why?
