Trigger-happy Police Shoot at Lawyers

In yet another bizarre incident of brutality, security forces opened fire at lawyers in Nepal

By Kiran Chapagain

Though the firing of bullets donated by the US and the Indian governments is a common scene in Nepal, I had not imagined that the trigger-happy police of King Gyanendra, would fire at a peaceful silent rally of lawyers.

But the mad police, who fired at peaceful poem recitation program of poets the other day, did fire at lawyers who were holding a peaceful rally.

When I entered the Nepal Bar Association premises, there were four polive vans. I was thinking that the police would arrest all the lawyers. I had not even imagined that the mad police of Gyanenrda, who prefers to see people being killed in the street to live up his super ego, will fire at lawyers without prior warning.

As around five hundred lawyers came out to the street breaking the chain of the police, the police could not arrest them. The lawyers reached to Babarmahal and sat on the street. Suddenly, a cop fired at the lawyers indiscriminately, injuring four lawyers. Then the police went berserk and rained batons on the head of lawyers. Around half a dozen teargas shells were fired. Senior lawyers, including Krishna Prasad Bhandari and Hahrihar Dahal were fleeing. Police were beating lawyers indiscriminately. A police kicked a woman pedestrian on her chest. The lawyers ran to Kathmandu District Court. The police then hurled stones and tried to break the gate of the Kathmandu District Court.

The blood hungry of police then became aggressive to journalists and human rights activists. “You human rights activists and journalists are all Maoists. Thok (beat),” a policeman yelled. Then a cop rained baton on Bimal Chandra Sharma of Insec. Already the cops had beaten journalists by singling out them.

The policemen kept on abusing human rights defenders and journalists. But our colleagues have succeeded to capture what the criminal police of the king did not the distinguish citizens of Nepal. That would enough evidence when the king will be presented before a criminal court some time in near future.

In yet another instance of state terrorism and crime, the police today beat disabled people who were holding a peaceful rally at Bhrikuti Mandap.

Yesterday there was a protest of staffs of donor agency, UN and INGOs in Nepal. The police also showed its nakedness and arrested the peaceful protesters. Now they are organizing a candle rally in capital later this afternoon.

One can imagine that when the donor community is also in the street, who is not in the street at present against the tyranny of the blood ministers and the palace.

Government employees, employees at the banks, public enterprises, even home ministry employees, doctors, lawyers, nurses, lawyers, journalists, teachers- all under the sky of Nepal, except some army generals and top police officers are in the street for a republic Nepal.

Surely, you must mean “five hundred lawyers” and not “police”.
The firing at the lawyers has been making headlines in international media as well.

Where are those exponents now who were legitimizing the brutual gun firing at Gongabu by saying police has the right to defend against the angry mob breaking in their house…what do you advocate now?..Were those professionnals also trying to breeze in to the house of some policemen or they trying to lurk inside narayanhiti….come on lads..wake up..these flunkies of paranoid king and schizo home minister can enter any time into your house and hit you with ballots and bullets for no reason.

All these “Government employees, employees at the banks, public enterprises, even home ministry employees, doctors, lawyers, nurses, lawyers, journalists, teachers” that the UWB article refers to unfortunately are people placed in these very places by the SPA leadership. If you want unbiased views, you are correct to say that they are shouting for restoration of democracy but please also mention that their loyalties lie and have lain with the SPA leadership well before the King took over and over the past decade. These people will jump when the SPA leaders say jump as their future depends on it and their past has benefitted from it. Atleast this King did not fire vast number of beureucrats who were not totally for him like Girija did when he was PM.
Is this democracy that we want either a Maoists run over and takeover, or is it a democracy for just the beneficiaries of the SPA leadership in the past fifteen years? Or do we want a democracy where all are included and this means the royalists, maoist sympathisers and maoists if they lay down arms, and all the millions and millions of under represented ethnic groups and minority and poor as well? Not just a SPA version of democracy, everyone has to be included no matter what their school of thought. Killing this one and that one will not solve problems. Ideas cannot be killed.

There is too much talk of a republic and some even go as far as to suggest killing the King.
How the hell are we going to attain any form of democracy when people who think of democracy diffrently from many in this blog site are shouted out for their views. This is cyber extremism. When an independent Himal survey suggests that two thirds of the population want a monarchy either in a constitutional or ceremonial form, where is the basis for a republic and that too in a violent manner.
When people who are too short sighted to see that excluding the views of people who may support the monarchy as an institution in a ceremonial or constitutional form, it only generates hate and anarchy.
What will be next – should we get rid of the police and the army as well? Or should we resort to an all inclusive democracy where institutions have to be improved whether it be the monarchy, army, police, judiaciary or political parties through a democratic process. I am sure all these institutions can serve our country in many benefiacial ways if we can all at least try to get along.

It’s now more evident that the police force, under the high command of Chairman Gyanendra, is devoting their strengths to suppress the voice of people. Earlier, as the Bravo pointed, the exponents of dictator Gyanendra used to blame that the police are triggered by protesters and maoists in some cases. It’s a shame that the bootlicker Kamal Thapa’s blame that maoist fired at ex-DSP’s house proved to be a complete fake and police’s accusation that maoist fired in Gongabu turned out to be a firing from AIG of police. The cohorts of self appointed Chairman are fooling the people right from the infamous Durbar mass murder. People are so helpless that they are not in a position to blame the criminal even though they all know the reality of massacre and subsequent capture of authority by power thirsty Gyanendra.

Given the scenario of tyrants rule and difficulties faced by Nepalese people due to maoist’s problem, the current movement of people should be directed to complete loktantra where Nepal would be known as People’s Republic of Nepal and the Government as Nepal Government and the tyrants and his cohorts should be enforced to the ground level.

Ideas can’d be killed therefore no matter how many people you kill today the noble idea of a new nepal where the government is for the prople, by the pople, and of the people will live on. So Gyane pull that trigger. You are the Hindu King so you surely must believe in Karma. What goes around must come around. With each bullete you fire you are only speeding up your ineveitable end. Ideas live on dictators don’t. Long live Loktantra.

If the king holds that much of popularity , why does he fear to hold an referrendum with an independent monitoring by UN? why does he fear to go to constituent assembly? If you think that king is so much popular, why people are not coming in large numbers ain the streets and chanting pro-monarch slogans. correct me if i am wrong, but himal survey might have been conducted in the capital or other city areas..where there are still some bunch of people who are fed up with SPA and hope that king will bring the country into track..they can wait for more than tree years..because they are not being cpmaparitively affected much by the deteroiating situation of the country..they are guarded and secured by the thousands of armys and police guard..but nepal is not all about kathmandu and some big cities..the people outside ktm cannot wait for more time..enough is enough for them. you can see why people in the outskirts of ktm like kirtipur and gongabu are demonstrating in thousands of numbers…because they know people outside the core capital doesnot benifit anything from this royal regime..be it security or anything

    Sl

ok all those officials and professionnal are SPA memeber? what about thousands of man, women and childeren outside kathmandu..are all they SPA. if that is the case..then in my thinking..SPA still enjoy the majority of popularity by the people of Nepal

    Bravo,
You stand corrected, it was a nationwide survey. Most of the survey was done outside urban areas. See the results for yourself in the latest Himal. And on your question of constituent assembly, this same survey showed that the majority did not want it.
As for people coming out on the streets and chanting pro monarch slogans – again most people do not want a direct rule by the King but it should not be mistaken for – no King at all.
As for the question of SPA popularity or lack of it, I’m afraid the only places they have any say at the moment is in urban areas, the people in the country side have lost faith in them a long time ago. Maybe this is why there was reluctance to hold elections by the several governments and party leaders before Feb. 1.

    Bravo,

I hope it is the SPA that enjoy the popularity outside Ktm. But one suspects there are Maoists leading the way. Besides in a country of 27 million, getting 50-60,000 out on the streets and that too with the Maoists in tow does not mean a majority.

    Bravo,

You are right in one way, knowing Nepal rather thourougly, I know that people here have a common point with quite a lot of democracies in the west : they like to have a king.

Honestly, if we had not chopped Louis XVI head in 1792, France would have become a democracy anyway.

But the fact is that the actual king of Nepal is the last of a bloody invaders dinasty : the Shahs, allied with the most powerful families of Katmandu valley, the Ranas.

And there seems to be no way out, as this very dinasty’s only heir, Paras, offer no hope to ever be a democratic king.

One solution would be, for ritual and cultural reasons, to revive and restore the heirs of the defunct Malla dinasty… but that seems a bit utopic.

It seems exotic, but think of it : this could offer a national consensus…

I wait a second such opinion poll to be conducted and want to see whether king is still popular after these recent incidents.

The cry for democracy by some seem to have no end. Some even tend to believe that democracy equals freedom.

Remember that Hitler was made Chancellor by the popular assembly of a republic. Remember also that democratic Europe has among the most cumbersome and burdensome state authorities of history.

Certainly the situation in Nepal is not worthy of admiration. There is war. Rights violations should be taken seriously, and they should be brought to an end. Democracy, however, is not necessarily the answer. The tyranny of the majority can be worse than autocracy.

In 1917 in Russia the monarchy was replaced by a democratic republic. A few months passed, Communism replaced democracy, and Communist rule was to last almost 3 quarters of a century.

Come the end of autocracy and what next? Thing is we don’t have a fool proof system. We shall be at the mercy of the 7 party leaders when they come to power. All they want is power isint it? And when they get it – where is the system to root out corruption??

We need a fool proof democratic system – therefore no matter who comes to power, obviously elected by the Nepalese, it will be self correcting and can eradicate power mongers and root out corruption. Question is how do we do it? Think we need to start planning for brighter days and be ready.

The ppl on the street – many of them don’t even know what’s going on and who or what they are fighting for. For all the youth – educated youth , our struggle should not be supportive or suppressive of any persons but the system. And anybody acting against the system is wrong – no matter who the person is. We should aim at the system – and since the system is no man or woman – we need to fight it intellectually. With the power of our brains and our pens – or blogs!!!

Our struggle right now is passive resistance and our struggle should be purely intellectual. The only way I’m gonna go to the streets is when I am sure it’s not a “7 party” thing but a “peoples movement”, when people are not paid to be there, but are there coz they know and support the reason and the cause. 7 party?? What 7 party??? Where are the 7 party leaders??? Why can’t they come and get a baton shot, or a stone on there cheek – what would it hurt??? They are willing to bring democracy whatever the cost right?? What about at the cost of their lives then??? Get them down to the streets willing to sacrifice life and limb and then we know they CARE –. We need leaders that CARE and LOVE Nepal. And we shall not compromise with anything less. Period.

Now you dont want surveys to take your survey and post it as everyones view either do you.

I can’t understand that when lawyers, artistes and journalists get beaten up and thrown into jail for peaceful protest how people can still sit on the fence. What is it about us Nepali people that stops us from seeing what is right and wrong and admitting it? It’s not Kantipur TV who is stating this it is CNN and BBC as well. BBC says that two lawyers were shot in the head with rubber bullets and thirty five were beaten up. I’m not very fond of lawyers or journalists but why the brutality?

Whoever you support-the King, the Maoists, the SPA alliance or just plain old democracy you must have the honesty at least to agree on what is wrong and what is right. I mean this isn’t a vague, philosophical question.

thanks for sending the poll results..i manged to go through the magagine article as well. But..i am afraid..i dont like the survey the way it was carried out…the survey doesnot seem to be scientific..they did not mention whether the sampling was representative…there is nothing written about the sampling technique..whether it was random..stratified..systematic..or others which is very imporatant for the validity of the survey..I could not even find out in which places of nepal the survey was carried out ..they said all over nepal..but which places in nepal..which urban and rural areas.maoist affected or not affected areas..along the highways..near the army barracks..who were the people giving opinion..army..govt officials..businessman..farmer..women..men etc, nothing written about that..forget about the other statistics like sampling bias and sampling error.

it is very important that the sampling should be carried out in a correct manner especially when it comes to be asking the people opininon and when it comes to the country like nepal. Again these kind of survey can never represent the people opinion in such a diverse country like nepal..even in India ..you might be aware of the last elction where BJP was predicted to be winning the elction with majoirity of seats..what happend next is all clear..again the survey was carried out before the agiatation..as proud to be nepali pointed out…it can be a completely different result if the same survey is repeated because of the recent incidents.

Even if i have to agree with the autheticity and validity of the results, I am still hapy to say that 65 % of people did not favor the direct rule of king. o why the heck you favor him staying

It’s really sad that a lot people seem to confuse democracy with the SPA, or the stone throwing and tyre burning of the last seven days. Just like the king is today being perhaps the worst enemy of the institution of monarchy, the SPA, when their leaders were in power, was the worst enemy of democracy.

I think people need to realise democracy and the SPA alliance are not the same. Look at the definition of democracy-it doesn’t say the SPA. However amongst the three major players in the politics of Nepal today, the SPA we all have to admit comes closest to democracy in their dealings. Not at all close enough for me but what other choice is there?

I understand that a lot of people aren’t democrats. Thats fine. But try not to confuse democracy with the SPA.

Here’s a link if you need to refresh your mind on what democracy means :-

    http://en.wikipedia.org/wiki/Democracy

The part I found really funny was the part below (reminds me so much of my country right now) :-

“The word “democracy” has acquired a highly positive connotation over the second half of the 20th century, to such an extent that even widely acknowledged dictators regularly declare their support for “democracy” and often hold pre-arranged show elections. “

Why do not you ask KG to contest Constituent Election and prove that this is what people want or contest a presidential election against what you call “corrupt” leaders and find out where KG stands? Or else, you are simply asking us to accept tyranny of autocracy, which we will not.

and I did not speak out
because I was not a Communist.
Then they came for the trade unionists
and I did not speak out
because I was not a trade unionist.
    Then they came for me
and there was no one left
    to speak out for me.

    Frederick Douglass:
Those who profess to favor freedom and yet depreciate agitation, are people who want crops without ploughing the ground; they want rain without thunder and lightning; they want the ocean without the roar of its many waters. The struggle may be a moral one, or it may be a physical one, or it may be both. But it must be a struggle. Power concedes nothing without a demand; it never has and it never will.

    people rise,

thankz for your douglass quote, its the most apt for this discussion. what G promises is a weak and unrealistic vision for our country. he is in no way capable of leading a country. he chooses to stay quiet when the people of our country are dying, many are out on the streets to protest against him, and many are simply escaping.

lets have a referendum. see who the people support. let the UN come into the country. we want a peaceful and prosperous Nepal.

Gyanendra, (gyanendra=all the people who claim aligiance to the idea that G will bring peace and sustainable democracy in our country) think. if you believe you have enough support lets go for a democratic referendum!

I have posted my blog in favor of Democracy three times now and it never gets published. What is wrong with UWB? I am saying again we need to restore democracy and bring Sirish Samshere and Kamal Thapa to Tundikhel and hang them.
    Prajatantra Jindabaad! Gyanendra Murdabaad!

We’ve heard the King’s speech and there is definite room for negotiations and reconciliation there. We all hope the govt. and the parties work something out.

Many people who did not like the survey said so, but like I said earlier it is just a survey. But if you believe in surveys that favour your line of thought and shout down surveys that may differ from your views then I don’t see what is so democratic about that. If you are interested in finding out details of how the survey was done, please ask Himal South Asia or Kanak Dixit.
Kirat is absolutely correct on his words on democracy, I could’nt agree with him more. However, the street politics show that the Moaists and the SPA have hijacked the term and are trying to call it their own. Outside Kathmandu, I hear the Maoists have mobilised most of the demonstrators, whether they are Maoists themselves or not. There is talk of their infiltration among the ranks of journalists and even human rights groups. Again, this is just what I hear from around the country.
G-Hangman, you are asking questions to answers I dont have. There must be legal issues involved with all of what you say, and the question of the peoples will also comes into it, and as you say you accept the survey results, so you will have also seen that over 80% of the population do not want a constituent assembly election, most just want changes to the existing constitution.
And as many other bloggers have stated, wanting an end to the King’s direct rule, (which at this stage I am sure most people of all inclinations agree with) does not translate to No King at all.
