Is New Nepal Heading Toward [Maoist] People’s Republic?

On August 21, 2008, the Communist Party of Nepal (Maoist), CPN (UML) and Madhesi Janadhikar Forum (MJF) agreed on the Common Minimum Program (CMP), Code of Conduct (CoC), Modus Operandi of the Government (MOG) and the formation of a Political Coordination Committee (PCC). The documents were signed by Prime Minister and President of the CPN (Maoist) Puspa Kamal Dahal (Prachanda), UML General Secretary Jhala Nath Khanal, and Forum chair Upendra Yadav.

The 50-point CMP is divided into: (i) Nationalism, (ii) Federal Democratic Republic, (iii) Peace and Security, (iv) Relief and Reconstruction, and (v) Socio-Economic Transformation. The excerpts of CPMs are:

(i) Nationalism concerning to unity and promotion

• Nepal’s sovereignty, national unity, independence and integrity shall be preserved, giving national importance to self-respect.
• National security, foreign policy, utilization of water resources, and mobilization of foreign assistance shall be based on Nepal’s sovereignty, independence, and welfare. Unequal treaties and agreements shall be reviewed.
• The foreign policy regarding neighbors shall be based on national interest, the UN Charter, non-alignment and the theory of Panchasheel.
• Financial assistance shall be taken from friendly forces, the UN and donor communities in the course of Nepal’s economic and livelihood development.
• National integrity and balance foreign policy shall be mobilized to internationalize and resolve the Bhutanese refugee situation.

(ii) State restructuring concerning implementation of democratic republic

• A New Constitution shall be framed within two years by forging consensus among political parties in the CA.
• All acts, rules and regulations that contradict with the declaration of republic on May 28, 2008 shall be scrapped.
• All efforts shall be utilized to trace the property of the former king and royalty.
• Special attention shall be paid to constitutional supremacy, independence of judiciary, fundamental human rights, press freedom and rule of law.
• The agreements signed with MJF on August 29, 2007 and United Democratic Madhesi Front (UDMF) on March 1, 2008 shall be implemented, but constitutional issues shall be decided by the CA.
• All women, Dalits, Muslims, Janajatis, Madhesis and backward people shall be included in all state mechanisms constituting and reforming necessary acts.
• Justifiable tax and resources shall be distributed to the backward areas, restructuring the country’s economic policy.
• Autonomous local government shall be established based on consensus of political parties till next local government is elected.
• Bureaucracy, Nepal Army, Nepal Police and Armed Police shall be mobilized independently forming a Monitory Task Force under the existing legal parameters.

(iii) Sustainable peace in realization for security

• The Peace process shall be ended at a logical conclusion through talks.
• The Maoists PLA combatants and arms shall be adjusted/managed within six months.
• A High Level Security Commission shall be formed to develop new National Security Policy. Nepal Army to be mobilized on development activities during the transition to peace.
• As per the Comprehensive Peace Accord (CPA), the National Peace and Rehabilitation Commission, High- Level Truth and Reconciliation Commission, High Level State Restructuring Commission, Commission of the Disappeared, and Land Reforms Commission shall be set up.
• Crime, anarchy and the culture of impunity shall be ended, consolidating law and order. To make independent and accountable administration and security organs, the Code of Conduct (CoC) shall be developed for the people’s realization of security.

(iv) Immediate relief concerning reconstruction

• Relief to families of martyrs and disappearances, rehabilitation of armed conflict effected families and internally displaced people, and compensation to the conflict victims who lost property shall be provided. A special Fund shall be established to manage rescue, relief, rehabilitation and assistance to the conflict victims.
• Medical treatment shall be provided to the people injured during the course of the People’s War, popular movement and Madhes violence.
• Top priority to reconstruction of infrastructure damaged during armed conflict shall be given.
• Price hikes shall be controlled; supply of fuel shall be smoothed; fair price shops shall be opened; and relief shall be provided to landslide, flood victims, etc.
• Debts of those who are below the poverty line shall be waived.

(v) Socio-economic transformation

• A National Independent Economy shall be set up based on the theory of people-oriented democracy and public-private partnership.
• Coordinating the State, cooperative, and private sectors; economic, social policy and programs shall be developed for social justice, economic growth and just distribution to address poverty, unemployment, backwardness, inequality and dependency.
• Immediate, short-term, mid-term and long-term development plans shall be established based on balanced development, people’s spirit and necessity of the country, restructuring the traditional National Planning Commission.
• Top priority shall be given to agriculture, hydroelectricity, tourism, human resources and physical infrastructure development.
• Land to the tillers shall be established in the course of scientific land reform.
• Top priority shall be given to national industries; special reform policy shall be adopted to revive sick industries; and special emphasis shall be given to small and cottage industries.
• Cheap, easy and effective services shall be provided, strengthening people’s service providers’ institutions. Both domestic and international investment shall be attracted.
• Rural electrification shall be given special attention to end load-shedding. Internal investment shall be encouraged for small and medium scale hydro-power.
• Loans shall be returned from big defaulters as per rules and regulations.
• Professional skill and commitment towards neutrality of the civil servants shall be enhanced. Culture of impunity shall be ended, pursuing transparency and governance.
• Effective corruption control shall be established. For this cause, concerned authorities, including the Commission for Investigation of Abuses of the Authority (CIAA), shall be strengthened.
• The participation of women including Janajatis, Madhesi, Dalit and disadvantaged groups at government mechanism shall be increased. Special package programs, such as education, health and employment shall be brought to them.
• A National literacy campaign shall be mobilized. The Government shall increase its budget to primary, informal, occupational and technical education. Fundamental education rights to secondary level shall be guaranteed.
• Primary and basic health shall be guaranteed as fundamental rights. The budget for drinking water, sanitation and rural infrastructures programs shall be increased.
• The construction of an east-west railway, international airport, irrigation, hulaki (post-office) highway, link roads to district headquarters, etc. shall be developed.
• Social security program for Dalits, disadvantaged classes and areas shall be created for inclusive development.
• Special programs and mechanisms shall be constructed, focusing to balanced development of Tarai (Madhes), hill, mountain, village and urban centers including Karnali areas and mid-and-far western Nepal.
• The country shall be declared free from untouchability.
• All kinds of discrimination such as rape, domestic violence and trafficking against women shall be ended.
• Special training and opportunity for employment or pension to disabled persons shall be managed.
• A High Level Youth Commission shall be formed to resolve their problems.
• Employment shall be guaranteed as a fundamental right to citizens. Security free loans shall be provided for business start ups. Foreign employment shall be managed to generalize equal access to commoners. Labor bank centers shall be established to record the numbers of unemployed.
• Discrimination against religion, dialect and culture shall be ended completely. A National Muslim Commission shall be established for their welfare and development.
• The demands put forward by the Non-Resident Nepalis (NRN) shall be fulfilled, and they will be encouraged to be involved more in Nepal’s development.
• All appropriate demands put forward by farmers, labors, students, teachers, women, journalists, industrialists, intellectuals, artists, doctors, engineers, lawyers, civil servants, professors, squatters, bonded labors, Badis, Muslims, disabled, etc. shall be fulfilled through dialog.

The CPN (Maoist) chairperson Puspa Kamal Dahal (Prachanda) became the first Prime Minister of the Federal Democratic Republic of Nepal, as he received more than a three-fourth majority (80% of 577 votes) in the CA on August 15, 2008. This is a golden opportunity to the world’s communist parties/tendencies to flaunt to anti-communist forces that believe that the communist era is over. After the Janaandolan I, the communists received a total of 37% total votes in the first general election of 1991, but now they have reached 63% in 15 years’ tenure. Why has Nepal become fertile ground for a communist regime? Why are communists, who are anachronisms elsewhere, flourishing in Nepal?

(i) the government in the past did not respect the spirit and sentiment of commoners, but was motivated by family particularly and party interest in general. The past government operated with a spirit of Hamro Manchhe rather than Ramro Manchhe (nepotism, favoritism and sycophancy rather than competency). For instance, Sher Bahadur Deuba had no role in the Janaandolan I, but the NC invited him from abroad and the party activated him for its cause. As the NC in particular succeeded in passing the amendment to hire and fire the PM by simple majority instead of the existing two-third constitutional provision, it is a sure bet that the NC will again engage in political musical chairs as in the past. Consequently, they now stand as an opposition political force. If the two-third provision had not been changed, the NC would also be in the government under the leadership of Prachanda.

For the NC, to remain outside the government is very challenging. The UML’s recent instance on the second cabinet position in the government after the PM is yet another power struggle divorced from the people’s interest. Bam Dev Gautam was twice prevented by the electorate from even being a parliamentarian and has allegedly indulged in money, muscle and mafia games as well. Large numbers of Nepali people believe that the UML wanted to stop Prachanda’a China visit under the pretext of the second in command cabinet minister port-folio fight.

(ii) The previous government not only remained silent spectators against foreign intervention, but also supported their naked games, much to the peoples’ frustration.

(iii) The economic gap between the elite and poor widened due to the “elite protected and people neglected” nature by the state in the past.

(iv) A culture of impunity flourished, owing to rampant corruption in the security forces, bureaucracy, judiciary and leadership.

(v) Nepal’s communists have a stronger sense of nationalism than the others.

The CMP tries to address all types of burning issues such as nationality, implementation of republic, relief and reconstruction and socio-economic transformation, even in this short-term government. Moreover, the CMP has incorporated education, health and employments as the fundamental rights which are very difficulty to fulfill by the existing traditional planning, acts, judiciary, income, and bureaucratic state mechanisms. The most perplexing fact is that most of the competent human resources are outside from the state’s mainstreaming. The ambitious CMP has stressed people-oriented and forward looking change similar to the Scandinavian model, prioritizing food first, apposed to the previous government which ostensibly stood for freedom first. In Nepal, a country that has never truly seen rule of law, this priority seems obvious to most.

The CMP focuses much on socio-economic progress while forgetting that this government exists simply to draft a new constitution and promulgate it. If the Maoist lead government fulfills its half of the CMP (public commitment), the people will be with them, but if they can not fulfill it, there is a danger of inviting socio-cultural violence that would be more painful and destructive than in the past. On the other hand, the implementation of the CMP will not be very easy, as the same anti-Maoists forces – Army’s generals, senior bureaucrats, diplomats, policy-makers, judiciary, and donors (particularly the US, who has not yet removed the terrorist tag from the Maoists) ? are trying hard to undermine the Maoists vertically and horizontally. Despite this, the Maoist-lead government’s public commitment is toward the eradication of poverty, assurance of social justice, and promotion of liberty minimizing the gap of classes that tends to initiation of People’s Republic of Nepal.

    If becoming a people’s republic brings prosperity, why would the Nepali people oppose it? Western or western minded thinkers will not agree with the concept of a people’s republic, but as they are entitled to their opinions and choices so are the people and political system entitled to developing a system which is essentially suited to our interests.

    Is it wrong to be selfish when it comes to our nation’s development? Is it wrong to eradicate poverty, assure social justice, promote liberty, develop the country highly, make the country and its inhabitants rich? Why can’t an ordinary Nepali be worth more than an ordinary American? What wrong would it be if Nepal was able to promote participatory democracy instead of representative democracy? What wrong would it be if Nepal were to be ambitious?

    Could the aversion toward a people’s republic be because of the west’s aversion/hatred/fear of people’s republics? Only Nepal should decide what type of government and economic system it want to be implemented. This will only be possible if we can develop a sustainable economy. And if that means we need to become a people’s republic then you’ve got my vote.

    Its good going, I hope this government will work with their consistency on CMP. Let this government to do by their own way. We want to see how this government will do best for public of all region. We have seen congress and other parties lead government and we are not satisfied with their work. Now the turn has gone to Maoist. This is the golden opportunity maoist has got. They should have to do work in favor of general public. They should have to work with the ground level. we hope this government will do better.

    Kishore something an indian intellectual had very good input on a europen tv about human rights and double standards. Since guantanamo bay nobody feels that western human rights advocates who beat people are in position to criticize China.
    China and India are growing economic powers, he states and Europe should encourage the muslim world around to develop. So they feel europe should not point the finger so much, we don’t want that. China has an emerging middle class and private property. India is a rich country in a different way. So cooperation is best in the area. Latin- america did not develop he said and we don’t know why. I know why they seem not so hard working as CHina. Chinese became hard working because there was a benefit to it, before a hairdresser could cut one persons hair in an hour for the same salary, now he makes money. There seems to be a worldwide discussion on development work and loss of money ( germany in Africa) by workin with the corrupt people. At this stage eurocentrism is not useful. His statement is that countries need leadership rather than democracy. There used to be a brain drain , now chinese intellectuals return to CHina after studying in the USA, Ph- d’s are returning also to India, because they have a good life there. Nepal probably needs regional solutions than save the children.

    China is no more a communist country now. Even during the Mao era China called itself a socialist country. But Mao was true believer of Marxism. He tried to get rid of religion.

    The Chinese constitution also states:
    “China is at the primary stage of socialism and will remain so for a long period of time. This is a historical stage which cannot be skipped in socialist modernization in China that is backward economically and culturally. It will last for over a hundred years.”

    The economy of China is now decidedly capitalistic in nature. The people can own the land, invest in stockmarket and deposit the surplus money in the bank. Due to this, there are three catagories of people i.e. rich, middle and poor. Mao would most likely be very unhappy with the state of current affairs in China if he were brought back to life. It is moving toward quasi-socialist system with capitalist characteristics. The British Labour Party considered themselves as a Socialist Party, but UK never been called a Socialist country. That is why socialist concept itself is controversy.

    Neil Horning, you exhibit all the signs of a communist. I have seen you in Nepalese blogs very often, and you have been consistent with your love affairs with Maoists. But Neil, at the end of the day, it is Nepalese people, and Nepalse people alone who will revise and reconsider their decision to elect terrorists as the largest party of Nepal! History will be in people´s side, and communists will eventually be defeated!

    I agree with “change”. A huge chunk of population has no idea of commuism and they dont know that millions need to die to get rid of it.

    Read the history of china. find out wht happened tiananmen square in 1989. find out if anyone dares to protest or organize a mass rally in china. televison is censored, internet is censored. public is fed only with the information tht the government seems appropriate. …. and the list goes on.

    janajati. you can turn and twist to adjust yourself to survive in capatilist world. You can justify and make yourself a feel good. We understand communist of the yesterday has lot to repent. Also, we beliver of capitalism understand you live with ego to rule the world and fail even to survive. We don’t come and hunt you as far as you adopt and follow capatilism. So my final suggestion is China is still politically a communist country. It has adopted a capatilism for economic survival because communist economic ideology in agraigarian society is absolutly impossible. Also, a reminder, socialism has nothing to do with communism ratther have great impact in its ideal from capitalism.

    What is the wrong with capitalist country if government take the responsibilty of the people ? I just mean to say that even in China class division has been started in terms of rich and poor. Which is clearly seen in urban and rural areas.The financial and living security is far less than USA and European countries in terms of health, education, unemployment etc.

    How do you define the word “communism” ?? It varies from the concept of Marx to Lennin, Marx to Mao and Lennin to Mao. Now whole concept of communism has been changed due to new economic reform of China. So, it depends from which angle you see. But from our angle, China is no more totally communist country now. And I am not criticising their changes and their economic development. I am more concerned with the term of “communism” only.

    janajati, communism is the same as it has always been, since Marx’ days. Communism = the classless society. No nation has ever been classless, yet. Mao’s China wasn’t classless, and as you quoted from the chinese constitution; the socialist era takes a long while before society develops as a communist, classless society.

    Soviet, China, Yugoslavia, Cuba etc etc. – neither of those were communist societies in marxist terms, they were socialist societies. Socialism is a base of society which mixes both elements of capitalism and communism, as communism isn’t something you can just declare… it has to be established in people’s minds and in how society functions.

    Clearly, they failed, for various reasons. But capitalism continues heading towards financial crisis. The number of imperialistic wars are increasing, it’s all about resources and controlling markets. Some day this system of corruption, oppression and warmongering, will develop towards a new society and be replaced. As feudalism was replaced by capitalism, capitalism will be replaced by socialism and communism.

    For Nepal’s part, they first have to develop capitalist conditions, move on from feudalism. And that’s exactly what the maoists are trying to achieve. Hopefully, they will succeed – and bring prosperity to the nepalese people.

    There is no comparison between social welfare concept of industrilized nation and communist China. Western social welfare system is base on egaltarian belief. All successful capatilist countries has some form of saftey nets for poor and disadvantages. Chinese story is different it has adopted a capitalism not to reach a fundamental of democratic idealism. It is based on absolutism ( absolute control of one party system) which drives society toward authorotarian regim where few powerful play the role. It is transfer the power from state to powerful few. Chinese high level capitalist are not common people. They are communist leaders. They control the means of production and have open execces to capital and field of investment. Communist party (only party) is the sole protector of these capatalist. It is perhaps different kind of communism but it is authorotarian communist country.

    In modern society non of the countries are neither capitalist nor communist. Western european countries prefer to call themself socialists because they incorporate the features of both communism as well as socialism. Even United States can’t be called 100% capitalist. Sometime they intervine in there economy.

    First of all, one should have to understand that communism is an economic system not political system. The meaning of core communism is a theory or system of social organization based on the holding of all property in common, actual owners will be community as a whole or the state. In Communism, where all forms of distribution, manufacturing and employment is controlled by the state.

    China is a communist in name only. They have an authoritarian system with a capitalistic economic system and socialism for needed services. The western europe and USA are similar with less authority. State capitalism, in its classic meaning, is a private capitalist economy under state control.

    In China, since people are allowed to own the property and even rent it, they can seek new and better employment or leave it, open a business, travel, immigrate, move to another city. In short, do just about everything that westerners do. The students of China don’t care about the politics and what the government is doing, but rather concerned with getting ahead, reaching the middle class or better dream. It has even been heard from the government side that they don’t spend enough time on education. China no longer guarantees health care, and one has to pay to get into public high school. It has private Wal-marts and McDonalds to shop at. They have now an extreme divide in social classes.

    We often hear that China is a authorotarian communist country. It is also not true becasue their system will not allow self political appointment and has control over all aspects of their country. They have the system to elect by their legislative body and must answer to them. Their legislative body is elected by those in the party, which can be anyone from a farmer to their leader.

    What we have painted a picture of China that simply does not exist today. The good thing about the China is they are moving ahead at their own pace. They know that instant change can bring social and political problems and it is best to go slowly in economic reforms. We can even say that China has invented some hybrid of communism and capitalism where their economy is developing that is why the goods are fulfilled in the world of China made.

    “Capitalism continues heading towards financial crisis.” Capitalism faces crisis but never continue. Capitalism never failed even though it faced numerous crises in human history. It has ideals and mechanism to correct itself if it is not intervening by outside irrational forces (such as communist,or totalatarism). Communism, however, being product of capitalism requires capitalism to find its place, both for its emergence and survival and eventually of demise. All industrialize especially G-7 are capitalists countries. They all go through economic cycle. Inflation, deflation, depression, wind fall etc. are expected economic terms of capitalism. They are expected phenomenon of capitalism. No capitalistic society has to endure national disintegration due to financial crisis. There is a reason for this. One reason is, it has ability to correct. It is a tranparent system by nature. No one can hide truth of production and consumption in capitalist system. On other hand communism hides it capacity of production and lies on ability of consumption. This is the very cause of Soviet downfall and Chinese’s adoption of artificial capitalism. History witness great depression during 30s in capitalist society nd they endure great crisis. But it did not fail. Truth is none of the country divided, it did not take long time to correct it. By 50s all these countries not only recover but increase prosperity which we people of underdeveloped countries and communist countries envy for. Communism when such crisis arises it abandons its citizen with lawlessness by adopting artificial system. It leaves citizen in mercy of mafias and communist thugs.
    Finally, ” feudalism was replaced by capitalism, capitalism will be replaced by socialism and communism.” It is a symlistic lineur thinking. Feudalism did not replace capitalism. Birth of capitalism is on the bed of feudalism. Fueudals who had excess (left over) invested on various fields- some sepent in building cannals other buliding ships and other invested on mining, some kings and fuedal gave mony to traders to go around the world trade goods. Fuedlism give foundation for capitalism. Socalism is foster child of capitalism. When capitalist have excess it agree to share to others. Successful welfare system of industrilize countries is not the idea derive from communism but the need of requirement of capitalism. Japanese multi nationnal corporation Honda, Toyota, Sony were a founded and guided by onetime fuedals who came from classes of Sogun and Samurai. British early capilist were all land owner. Early American Bankers who provide loans to industries, mining and railways were land based capatalist.

    Salaries are better in netherlands than in Italy in the fashion industry. Neither country is communist or less or more capitalist. It is hotter in Italy the people are lazy. Then they suffer because they are poorer and so on. In Holland it is always raining so we are happy to have a job to go to. Even volunteering is good.
    In Mexico people are obliged to go to USA because of better salaries so take the kids to disneyland.
    A good system is a system that takes care of the weaker, USA has a problem with immigration movement, weakening economy, pensions and many good things Nepal will not have yet in the coming 50 years. Westerners like Nepal because it is like the middle ages, animals in the street.
    But nepalese people like the 21st century. Robin Hood Prachandra, and China is good. Yes I also have a birthday party in Shanghai tomorrow and do not want my visa to be turned down. amitofu. One should be able to say China is ok but let them have more than one child and still obtain a visa.

    chandra human nature is the point where communist theories fail, some grap power for the benefit of themselves….
    I do not think that is Prachandra I do believe Baburam and Hisila are nearly holy.
    But the shitheads in the streets are worse than mediocre.
