The government of Girja Prasad Koirala is responsible to the YCL action against currupt and bank defaulter Sita Ram Prasain

Many of us have been asking this question since the day before yesterday when we knew that the YCL “arrested” Sita Ram Prasain, corrupt and bank defaulter from his office in a dramatic manner: How do you react? Many people have been reacting in two ways:
1. That’s wrong but this guy should have been arrested by the state long time ago.
2. That’s right because this state is not representing the rule of law (which means arresting Sita Ram) and, in that case, anyone can take laws in their own hands.
The Maoist youth wing Young Communist League (YCL) Monday handed over “wanted” former chairman of Nepal Cottage and Small Industries Development Bank (NCSIDB) Sita Ram Prasain to Kathmandu Police during a press meeting yesterday afternoon. The YCL had taken Prasain – against whom the government had issued arrest warrant for involvement in financial irregularities — under its custody Sunday alleging the police of “showing no interest in making his arrest.”
“We handed Prasain, who has been involved in corruption and irregularities to the police to take action against him. We took this step to begin the process of building a corruption free new Nepal. Although Prasain admitted of committing financial irregularities, he maintained that no arrest warrant had been issued against him.”- Sagar, Valley Incharge of YCL.
“I did not do any wrong and I am ready to face any punishment if the court finds me guilty. I did not get any summon and I am not involved in activities to destroy the bank.”- Sita Ram Prasain
I think I support the first reaction but won’t condemn the second one as well. I don’t blame YCL or Young Communist League, the youth wing of CPN Maoist, for Sita Ram drama. Girija Prasad Koirala, the Prime Minister of the coalition government, can’t escape easily from the drama by just providing us the new full form of YCL: “Young Criminal League.” Yes many of the YCL activities are deplorable and criminal like in nature but in this case it’s more to do with the failure of Koirala or the State than the whatever-brand act of YCL. If YCL is a “criminal” outfit because they arrested Sita Ram and handed him over to Nepal Police for further legal proceedings, Koirala is also a criminal because he, as the prime minister of this country, wasn’t implementing the rule of law by not arresting Sita Ram. Koirala said that YCL made a joke of law and order. Right. But what the hell was Koirala doing? Exactly the same. It was widely believed that Koirala was actually providing security and environment to a criminal like Sita Ram Prasain instead of arresting him. The government’s inability of arrest Sita Ram Prasain had made the joke of law enforcement agencies in Nepal. Prasain was openly throwing out parties in which who’s who of the political circles attended. Communist chameleons like Modanath Pashrit were writing columns giving reasons why they attended the Sita Ram Prasain party and were not feeling guilty over their deeds.
Under directions of the Nepal Rastra Bank, the Police Headquarters had issued arrest warrants against Prasain and other senior officials of the financially-troubled bank on charges of extending loans with the intention of fraud, causing a loss of Rs 280 million to the bank on August 22 last year. The arrest warrant against Prasain was issued after Nepal Rastra Bank forwarded a number of cases to the financial crime branch of Nepal Police after its initial investigations found that some of the cases attracted the Fraud Section of Civil Code. Prasain, however, was open and wild. He was attending public functions and running Universal Tours and Travels, the general sales agent of Korean Air, as chairman. Despite the claim that police headquarters had circulated the arrest warrant to all its regional offices, Kathmandu District Police sources said it never received such a warrant.
After they received Sita Ram Prasain from YCL, the Kathmandu Police immediately filed a case against him in Kathmandu district court. Look at that! How can you speak against YCL, particularly in this case, if you are filing case against the person ‘arrested’ by YCL and handed over to you? YCL got immunity from its earlier ‘criminal-like activities’ because of Prasain incident. And we must admit Koirala provided the cover to YCL by not arresting his relative Prasain.

After spotting him, they should have stopped him from escaping and called the police to have him arrested, instead of capturing him themselves and taking into their custody.
There still are more great culprits in the big parties,proved for their corruption by the Court and the Akhtiyar, and master of many great scandals of our time.

On GPK – I have said it before and I say it again this chap should quit and appoint someone else PM. I don’t buy the argument about GPK being the guy holding all together theory. The fact is he does not allow any one capable even within his shadow – just a bunch of yes men.
If this Prasai is guilty the YCL chose a perfect target to do a publicity stunt. I call it that because that is all it was – they could have just caught him and handed him to the cops without the khula munch circus.
The fact is the govt. is not doing it’s job in keeping law and order. I say good on the YCL if they are doing a citizens arrest but now the government should take the hint and do their job.
Oh yes – let’s not forget to remind the YCL fellows that if they want the govt. to do their job then they have to allow their cadres from getting arrested as well for criminal activities. But they seem to stage protests when cops catch criminals within the YCL. Does this mean they can do what they want, but if one of their own is in the wrong no one can touch them? (we have had enough to the neck with – we will look into the matter and take action by the likes of Prachanda and co.). So what is the point of this publicity stunt when you can’t practice what you preach?
Now, lets see in right prospective. YCL is not the police, YCL is doing these actions to discredit the existing apparatus and YCL is not limited to capital city only. If you look at it- all these add up to a very nefarious design by the maoist.
Rather than putting out a knee jerk reaction by saying what they did was right- see it little deeper and that should send chills down your spine.
Parsian may be the crook (white collar criminal) and he deserves to be given day in court and if convicted then he should face the sternest sentence- due process of law is a hallmark of democracy. This does not mean giving free license to willful criminals rather a level playing field to everyone- be it a victim or the perpetrators of crime. None is allowed to take law into their own hands to gain popular support, incite vigilante tendencies, and support retribution without proper due process.
Once again let me end by saying -Multiparty system with Constitution Monarchy.
DOA , you are right on the money….. absolutely correct… this is the most obviously explanation for why Pushpa Kamal and ceremonial Baburam keep saying– we didn’t enter the cities to go back to the jungle. Well, why would they? They have brought the jungle with them to the cities. This is rule of the jungle on display—- law? what law? order? what order? 3. Prasai had not killed any CRIMINAL too forget about killings of innocent people.
4. No doubt Prasai should be tried, but who will catch and punish the killers.

and why is the Truth and Reconciliation Committee not formed yet? This was one of the major promises that the terrorists made when they joined the government. This committee was to find out AND punish all those from both sides of the war who killed, tortured, disabled and displaced all those innocent people who were never on either side of the argument. ALl they wanted was to live a peaceful lives with their families. Now, those dead ones and their families want justice. True, people like Prasain should be tried and punished IF found guilty, but these killers who are walking around the street preaching the country about what kind of set up is best, should be made accountable for their atrocities as well. Empty apologies aren’t enough!!
The issue we are debating is lot more serious than whats in the surface. Are we being forced to accept activities against all the tenet thats hold the society together or are we being readied as scarificial lamb to be slaugthered.

I am in disbelief here at some of the bloggers. The issue isn’t wheather Sita Ram is innocent. That is far beyond the point. The point here is that you cannot allow groups like the YCL, who have no authority, to take law into their own hands and go around acting like vigilantes! The YCL is not an apparatus of the state. The group is comprised of former Maoist combatants. Why they are not in their camps should be the real question here. If you condone their today, who knows what they will do next. What we know about the rule of law ;
Government decisions are made according to written law and rules
Rules are applied as much as possible consistently to all
Courts provide citizens consistent, written process (due process) before life, liberty, or property is taken
Courts provide reasons based upon the law for their decisions
The difference between “rule by law” and “rule of law” is important. Under the rule “by” law, law is an instrument of the government, and the government is above the law. In contrast, under the rule “of” law, no one is above the law, not even the government. The core of “rule of law” is an autonomous legal order.
The opposite of rule of law is rule of person. There are two kinds of rule of person. The first kind is “rule of the few persons,” examples of which include tyranny and oligarchy. The second kind of rule of person is “rule of the many persons,” an example of which is the ancient Greek democracies. The common feature of rule of person is the ethos that “what pleases the ruler(s) is law.” That is, under rule of person, there is no limit to what the rulers (the government) can do and how they do things.
There are two common misconceptions in China. First, when some writers describe “rule of person,” they mean only “rule of the few persons.” These writers think that, as long as we have democracy (“rule of the many”), we have justice and rule of law. These writers forget that the popular will can rule with or without constitutional and legal limits. Without constitutional and legal limits, popular will can be as destructive as, or even more destructive than, the unfettered discretion of “the few.” Examples include the injustices of classical Greek democracy, terrors of the French Revolution and the crimes against humanity committed during the Chinese Cultural Revolution. Second, some writers in China think that, as long as laws are passed through democratic procedures, they represent the general will (a la Rousseau) and therefore are just laws. These writers forget that “popular will” is not necessarily “general will” (as Rousseau himself warned us more than two hundred years ago). Unfettered popular will can not only deviate from the Rousseauian general will, it can run against and destroy the general will.

In other words, the government cannot simply define a new crime and apply the new definition retrospectively. -All people should have the right to participate in government. Governments should create laws that protect human rights while justice systems enforce those laws equally among the population.
-Freedom from arbitrary arrest, detention, and torture — whether one is an opponent of the ruling political party, an ethnic minority, or even a common criminal — is a basic human right. A professional police force respects all citizens as it enforces the laws of the nation.
-In ethnically diverse nations, religious and ethnic minorities should be free to use their language and maintain their traditions without fear of recrimination from the majority population. Governments should recognize the rights of minorities while respecting the will of the majority.
-All people should have the opportunity to work, earn a living, and support their families.
-Children deserve special protection. They should receive at least an elementary education, proper nutrition, and healthcare.
-To maintain human rights, citizens in any free society need to be vigilant. Citizen responsibility — through a variety of participatory activities — ensures that government remains accountable to the people. The family of free nations is committed to work toward protection of human rights. They formalize their commitment through a number of international treaties and covenants on human rights.

Minister for Information and Communication Krishna Bahadur Mahara on Tuesday said the government would take concrete steps to develop the communication system and infrastructures in the country as per its motto ‘meaningful, pro-people and inclusive information and communications, basis of loktantra, peace, national interest and progression’. He also said that he would make the ministry under him ‘paper-less’ within three years time and develop it as a ‘model ministry’.

Unveiling the future plans of the Ministry of Information and Communications (MoIC), Minister Mahara said the government would take concrete measures for the development of mass communications, government media, internet service, postal service, including others.
Minister Mahara said as per the plan, the government would set up at least one phone line in every polling booth by the time of the constituent assembly polls and also extend its support to the media to publicize about the constituent assembly polls.
“Since this is a transitional period we had some difficulty in determining the plans,” he said, adding, “but now we will do what it takes to materialize it. I am going to present it before the cabinet soon.”
He further added that as per the plan to install telephones in all remote villages, all 1007 Village Development Committees (VDC) which are yet to get connected by telephone will have a phone line within ten months. Mahara also expressed his commitment that the government would try to realize the slogan of ‘mobile sets in everyone’s hand and internet in every home’ in practice.

As claimed by you, YCL are doing good things by catching criminals. If they can catch people like prasain, how come they can’t catch criminals who are involved in robbery and kidnaping in Kathmandu? , and these crimes are taking place almost everyday. Actually, they are the ones who are involved in such crimes in Kathmandu. There is a saying: an elephant has two teeth, one to show and the other to eat with.
Good advice by Dewaz, other parties and groups should do work. But you have to understand if other parties do it, the YCL get pissed and start a fight. These goons do not even allow other parties to hold gathering and talks freely in the country side and you talk of his? This is the norm. They want to monopolise their criminal behaviour and the token sweeping of streets as well to cover up their activity. But the people cannot be fooled all the time.
It’s definitely a political stunt by the maoists to purify the tarnished image of their criminal outfit called YCL. Having said that Mr Prasain deserve to be behind bars but he definitely is not the only one deserve that treatment. So each and every member should be worried about this development. Once the great judge has said that it is better to leave 100 criminal than to punish one innocent man. We should be more focused on making our court systme, police system better than to go for quick justice. it was very funny last night to watch teacher Pushpa Kamal have a go at India just because India was saying that the best way out for Nepal is through co-operating between UML and NC. This moron, on one hand, wants us to believe that his doctrine us supreme, flawless, his party invincible and his move irrversible. ON the other hand teacher Pushpa Kamal gets ruffled by everything under the sun– king’s speech, dakshinkali visit, Moriarty, now India etc. That just shows how empty this guy is on the inside. Rather than worry about the meeting between Makune and Sardar Manmohan, Pushpa Kamal should be spending time preparing an explanation to the people of Nepal about whether or not his party has links with ULFA as was admitted by two of the ULFA leaders yesterday. He used ceremonial Baburam yetsrday to deny this charge, he has got to come out clean else he and his disillusioned terrorists communists gang (not a party) can start their walk back into the terrorist list.

Some YCL cadres, who showed up at Purtighat Bazaar where Dhakal was distributing wages to road construction workers, took him away and beat him up badly.
According to Sheshkanta Gautam, another CPN-UML district committee member, Maoist cadres Givinda Nepali and Chhatra Bahadur Thapa who also claimed to be YCL members, took Dhakal to the house of one Tek Bahadur B K and beat him up.
Dhakal, who was seriously injured in the beating, was taken to Butwal for treatment.
According to locals, the Maoists are yet to allow Dhakal, who is also former VDC chairman of Harmichaur, to return to his village in spite of the Comprehensive Peace Agreement and formation of the interim government. He was displaced during the insurgency.
Meanwhile, issuing a statement, the CPN-UML in the district condemned the attack. “We expect the Maoists to improve their behavior and not mistake our restraint for weakness,” said the statement.
Headmaster too not spared YCL cadres led by some locals thrashed Ishwori Prasad Bhushal, principal of Gorlyangdham Lower Secondary School of Hoshrangdi VDC, on Tuesday night.
According to CPN-UML district committee secretary Bikash Lamsal, the YCL cadres led by two locals–Suresh Gurung and Dinesh Gurung–beat him up over a dispute concerning the building of a local roadway.
Bhushal was taken to Pokhara for treatment as his legs became dysfunctional following the beating.

It would be really nice and lesson for YCL if they could read this blog to improve their behavoir but don’t think those thugs having guts to read those 82 comments mostly against them. My comment re this incidence was ALONG THE LINES OF why do the YCL bother with their publicity stunts if they cannot refrain from scratching their notorious itch for atleast a while?
By that logic all the Maoist leaders should be caught and put behind bars for all the killings that took place during the last few years. I don’t know if this blog or anyone is following the issue of releasing the salary of the “PLA” in camps before verification? A precondition that should simply not be allowed. Why? Because the estimate is that half the “PLA” are minors or recruited after April 2006 – it’s just a way for the maoists to pay off the fake PLA as promised by them and send them packing off. Why should these recruits get this pay? Also, the deal was no more conditions and yet the govt. submits. Fine we don’t want to create more delays, but what if the UN says that the released salary should be given to the UN not the maoist rep. at this stage and the salary should then be distributed after each “PLA” individual verification? If they are in they get their pay, if they are out they go home without pay.
Another story which should be of interest is the Assam communist party story and setting up base in Nepal – why is this blog not writing on this – wakey, wakey!
Really shameless, how the royal Mafia is defending their white collar criminals and taking every event where drunken youth play fight as a justification to keep their grip on power.

Nepal needs a big civil movement following the rules of nonviolence strictly to deeply change.
Maoists are deperate as their path of partly abandoning violence and all the bowing in front of the superpowers did not bring the wanted political acceptance, so they resort to the old concept of violence.
But the true devils are the ‘godkings’ and their criminal supporters who have kept Nepal undeveloped and illiterate as they were allowed to exploit.
You can fool some people sometimes, but not all the people all the time.
So you robbers, you corrupt white collar ‘business’men, you crawling politicians, do not expect the Nepali youth to be so easily fooled and cheated again. The longer you try to water down the true desire of the Nepali people for fundamental change the heavier the tsunami will come and wash you away.

Please please don’t cry. I didn’t mean to offened you. I didn’t realize that you are not mature enough to deal with some bad words. You see, people like Amanhush deserve nothing less. There is somethings in this world that is just plain wrong. The YCL is one such thing. My bad words is the result of my frsutration and disbelief that literate people who can use the Internet can still support an outfit like the YCL. Anyway my apologies.

Look, a lot of how Juntas react depend on how the international community and media react. Myanmar has a military regime but if the ambassadors in myanmar act like the ambassadors here, i am sure that regime will not prosper for long. My point is we are being brainwashed by media, International community and the SPA (the maoists can stay out of this). It is not the youth that is burning tires but instead it is the SPA, the maoists, the indian embassy and so on. Once these interferences are defeated, we will move forward.
