The government of Girja Prasad Koirala is responsible to the YCL action against currupt and bank defaulter Sita Ram Prasain

Many of us have been asking this question since the day before yesterday when we knew that the YCL “arrested” Sita Ram Prasain, corrupt and bank defaulter from his office in a dramatic manner: How do you react? Many people have been reacting in two ways:
1. That’s wrong but this guy should have been arrested by the state long time ago.
2. That’s right because this state is not representing the rule of law (which means arresting Sita Ram) and, in that case, anyone can take laws in their own hands.
The Maoist youth wing Young Communist League (YCL) Monday handed over “wanted” former chairman of Nepal Cottage and Small Industries Development Bank (NCSIDB) Sita Ram Prasain to Kathmandu Police during a press meeting yesterday afternoon. The YCL had taken Prasain – against whom the government had issued arrest warrant for involvement in financial irregularities — under its custody Sunday alleging the police of “showing no interest in making his arrest.”
“We handed Prasain, who has been involved in corruption and irregularities to the police to take action against him. We took this step to begin the process of building a corruption free new Nepal. Although Prasain admitted of committing financial irregularities, he maintained that no arrest warrant had been issued against him.”- Sagar, Valley Incharge of YCL.
“I did not do any wrong and I am ready to face any punishment if the court finds me guilty. I did not get any summon and I am not involved in activities to destroy the bank.”- Sita Ram Prasain
I think I support the first reaction but won’t condemn the second one as well. I don’t blame YCL or Young Communist League, the youth wing of CPN Maoist, for Sita Ram drama. Girija Prasad Koirala, the Prime Minister of the coalition government, can’t escape easily from the drama by just providing us the new full form of YCL: “Young Criminal League.” Yes many of the YCL activities are deplorable and criminal like in nature but in this case it’s more to do with the failure of Koirala or the State than the whatever-brand act of YCL. If YCL is a “criminal” outfit because they arrested Sita Ram and handed him over to Nepal Police for further legal proceedings, Koirala is also a criminal because he, as the prime minister of this country, wasn’t implementing the rule of law by not arresting Sita Ram. Koirala said that YCL made a joke of law and order. Right. But what the hell was Koirala doing? Exactly the same. It was widely believed that Koirala was actually providing security and environment to a criminal like Sita Ram Prasain instead of arresting him. The government’s inability of arrest Sita Ram Prasain had made the joke of law enforcement agencies in Nepal. Prasain was openly throwing out parties in which who’s who of the political circles attended. Communist chameleons like Modanath Pashrit were writing columns giving reasons why they attended the Sita Ram Prasain party and were not feeling guilty over their deeds.
Under directions of the Nepal Rastra Bank, the Police Headquarters had issued arrest warrants against Prasain and other senior officials of the financially-troubled bank on charges of extending loans with the intention of fraud, causing a loss of Rs 280 million to the bank on August 22 last year. The arrest warrant against Prasain was issued after Nepal Rastra Bank forwarded a number of cases to the financial crime branch of Nepal Police after its initial investigations found that some of the cases attracted the Fraud Section of Civil Code. Prasain, however, was open and wild. He was attending public functions and running Universal Tours and Travels, the general sales agent of Korean Air, as chairman. Despite the claim that police headquarters had circulated the arrest warrant to all its regional offices, Kathmandu District Police sources said it never received such a warrant.
After they received Sita Ram Prasain from YCL, the Kathmandu Police immediately filed a case against him in Kathmandu district court. Look at that! How can you speak against YCL, particularly in this case, if you are filing case against the person ‘arrested’ by YCL and handed over to you? YCL got immunity from its earlier ‘criminal-like activities’ because of Prasain incident. And we must admit Koirala provided the cover to YCL by not arresting his relative Prasain.

Girija is too busy thinking Monarchy or no Monarchy, Republic or Ceremonial Monarchy. It’s time to clean up Hard Drive in his brain. There are too many useless information in his brain.
The YCL are a bunch of thugs. However, I really can’t pass judgement on this particular case although media have reported that this guy is a wanted man – but then the media are also full of garbage so, who to believe? The fact is if he is a wanted guy, and the government did not do anything to catch him and the YCL did so be it – call it a citizens arrests. BUT, if the rest of us start catching YCL thugs and even past murderers (like the murderer who bombed the bus in myagdi, chitwan), will the YCL say that’s alright? Will they? I doubt it. So either they stop doing this publicity stunt or allow others to do it as well. What say you?
Great but who’s arresting the criminals in the YCL?
I think citizens should now all go out and start arreesting all the crooks and criminals, starting with GPK, MKN, Prachanda, King everyone. Let’s not spare anyone. Why do we wait for a warrant from a corrupt judiciary anyway to find someone guilty. Even the judges should be arrested. When do we begin?
As GPK said YCL for “Young Criminal League” he google % rite. Catching one person and starting propaganda about will in-fact not make them hero. They are responsible for the destruction of billions rupees of National infrastructure. What about the bank robbery and other criminal activities, what about the life of 14000 people they killed to come to parliament.
Regardless of wheather this man is a criminal, the YCL has no right to go around acting like vigilantes. This is a slippery slope. Besides the YCL has no moral, legal or any other authority to arrest anyone. Like kp pointed out, who is regulating the YCL thugs?
I prefer the days when these Maoist sons of b*itches used to run and hide at the sight of RNA choppers.

For once, I think I agree with the conclusion here. SPA’s inability to maintain law and order and their brazen mockery of the same by harboring and entertaining national criminals like Prasain are giving Maoists and YCL ample political opportunities. Although you and I wouldnt agree the way YCL have taken law into their hands, but to the thousands of commons such deeds of YCL look herioc and dilutes much of their criminal activities of the past. Hence, I’d blame GPK and his SPA coterie for this first.
I think SPA’s strategy of marginalizing Maoists by letting them get away with anything so that they fall in the eyes of the public are proving to be counterproductive. They better start thinking up. Once advice – SPA could start by trying to champion Madhesi, Janjati, Dalit causes.

On this particular issue, i think YCL did a good job, regardless of thier past violence of forced donation and even killings. Its was a good step to give a gesture of “In Your Face” to Girija, and Madhav Kumar. I was wondering why Madhav Kumar Nepal hasn’t made any comments regaring this issue. He attended Parsai’s party didn’t he which wasn’t goodto his image. Well who am i taking about, just another piece of poop.
I agree with Neil Horning. The Maoists threw out some bait and the idiot Girija took it hook, line and sinker.
But at the end of the day, the Maoists are doing everything they can to not make a CA election process, possible. They are violating so many of the CPA and arms management articles, it’s not even funny. They are creating a situation where electiosn can’t be held so they can blame the government, sideline it and gradually exert their influence using the YCL.
Side note to Maoists – I hope you have done your homework well on Hitler’s difficulties with his Brown Shirts, after he came to power.

People the real crook in this issue is GPK…being a prime minister of a country why did he protect Sitaram Prasain? Just because he is a relative via marriage? When PMs take such corrupt, crooked steps it is the YCL goons who take advantage. This time, i really appreciate the YCL for their activities. Why the GPK is blaming them for this task while he used to be silent on their lots of terror activities? I do not think Sita Ram Prasain should not be behind bars, but these YCL thugs have no right to cross all these legal limits. See it like this- When SPA allows these things to happen- they should morally be responsible. Now, it is for them to act not only speak as an afterthought and label them criminals. Does anyone know how they (YCL) is funded and who gives them the right to do as they see right (vigilante). YCL acts because it feels it can, not otherwise. The leeway given by SPA, official or not, makes them a parallel force so the act they do seem right whereas if you look from the governance point of view – it just a opposite. By taking law unto their hands- they are actually setting a precedent- one is muscle is the key and next is they are the law, justice, and punisher rolled into one- semi government within government. does Prasain have any right to bring abduction charges against the YCL for keeping him in custody for one night against his will before being handed over to the police…. and has anyone established the fact yet about IF there was ever a warrant ever issued against the guy? Because if there was a warrant issued then the current government is at fault and what YCL did can be justified. But, again, this will only give the right to YCL to repeat the act with everyone that may be accused (not proven guilty) by anyone in this country. For example, if Neil was to overstay his visa in Nepal on the backing of the YCL, the tarun dal members can come looking for him, keep him in custody for one or two nights and then hand him over to the police. This will never be justified. So, on the face of it, it will look like the hooligans aka YCL, “did” the job of the government but we need to know for sure if this guy was officially chargesheeted and thus was abscounding. Even in that case, it gives no right to YCL to go it alone on this one and keep the guy in thier capitivity for a night. This should have been a joint operation and the guy should have been in prison the same day not in YCL’s terrorising custody!! And i read above in someone’s comment saying Girja is probably mad about police not catching … “Sita Ram” … wat a joke .. he was fully surrounded by police during his party .. but they were not there to catch him .. but to provide sequrity … cause police can’t catch “Sita Ram” because of Girja ( “Mathi ko Adesh” )……………..
dewaz.. if you get your news and ideas from newspapers despite of living in kathmandu then you might want to consider alternative ways to getting, processing news and then form an opinion… I do live in Kathmandu and I did read the kantipur piece twice– both those articles said that arrest warrants were issued by the police headquarters– at the time of Prasain’s “arrest” by the hooligans they calimed that there was an arrest warrant issued by “Rastra Bank”. The YCL also said that they were requested by Chairman of Nepal Cottage and Small Industries Development Bank to “arrest” Prasain. The police ha a story that said that they were forming a case against Prasain (no mention about the warrant) but the bank chairman wasn’t “co-operating” with them. So, after all this, all I was asking was – has anyone established the fact that if a warrant was issued at all? We can’t be swayed by these hal-reporting newspapers to form our opinions. So, since you live in Kathmandu or “read the newspapers”, may be you can help us out here.
and what was ironic was Chandi Dhakal was seen with both Girija and Pushpa Kamal plus ceremonial Baburam in two different functions on the same day of Prasian’s hand-over….. now, who is protecting this other defaulter? Or was he able to pay the exhorbitant sum in bail to be out in public so blatantly? Anyone know, how he paid the bail?

YCL action is acedemic. If some thieves were running can public catch them or not? GPK shouts about the human rights but he should also take care that criminals are not walking free challenging the system as a whole.
Incident like these will be on rise. When such incidents are encouraged chances are that the innocents will suffer.
Has anyone denied that the Nepal Rastra Bank asked the Nepal Police to arrest Mr. Prasain on charges of fraud? Was there an arrest warrant against Mr. Prasain before he was ‘arrested’ by YCL? If there was an arrest warrant against Mr. Prasain before the YCL ‘arrested’ him than the whole incident reflects very poorly on GPK and Makune who went to his party just recently. That the criminal YCL is doing this just for popularity sake is clear but the main culprit seems to be GPK if he has been ‘protecting’ Mr. Prasain.
I agree with guyformKtm. Why they are safeguarding and praising one defaulter and punishing the other one if they are in the same category. Either because Parsai is being Chettri or he has not given the ransom which was demanded by the maoist.

Yes, there are many a warrants from police to different persons for different crimes. They deviate the rules of law behind the curtains to show themselves a law abiding person. Sitaram Prasain never did that. He always liked to break the rule and show it boastly. Sitaram Prasai was always distributing part of the loot money among the politicians(Modnath Prashrit has acknowledged it) and police high-ups and call themselves ‘his well-fed loyal dogs’. He felt himself very powerful and behaved like crown prince Paras in by-gone days. If any of you people ever met him in his drinking orgy, you immidiately find his real persona. Sitaram is right – ‘loyal dogs never catch their master however mad he is’ and Sitaram roamed for ten months free opening ceremonies, throwing parties, meeting high-ups but wild dogs roaming around in the valley nabbed him. Chandi Dhakal, though president of Udyog Banijya Sangh, could not behave like that and sent his imissary to proper authority to deal the matter as a law abiding one as he was rich and strong but not so powerful as Sitaram is.
YCL action may be improper but hardly can be illigal because any citizen can bring a fugitvive to police and Sitaram Prasain was an arrogant fugitive whom one individual can not handle.
GPK was never a wise person to express the situation in proper way. What he said was not for Prasain but for other people who can be nabbed in that very manner. No prime minister can justify such act whoever did it.
