Six reasons why I don’t accept this Vice President for Nepal.

Preamble:

All over Nepal, protests against Vice President Paramanda Jha are being organized because he chose Hindi as the language while swearing in. There are ongoing debates in Nepali blogs, news sites and Facebook forums. This is one of them:

I am not advocating anywhere that anyone of Terai or Madhesh origin or even Indian origin for that matter becomes “less -Nepali” than anyone of us. Many Nepali-speaking people have let down the entire nation and betrayed the people. Yes, they have. The King used to speak Nepali but people didn’t like him. Ditto with many other Nepali-speaking leaders. I also don’t believe that people can’t use a language of their choice in day-to-day use. Please bear these things in mind and continue reading.

0. Criminal Act

According to the Interim constitution of Nepal (which I hope a Vice President is liable to), Hindi is not one of our national languages. Also, according to the 5th amendment to the constitution, Vice President can take oath only in the language of official work, i.e Nepali.

Violating constitution, whether by an ordinary citizen or a Vice President. is worth contempt. He violated the constitution even before he assumed his office.

1. Promotion of wrong values

Practicality is too vague and flimsy a comfort to be allowed to “abide rules”, “set example”, be a symbol of national unity, and most importantly, run a country.

Speaking yesterday in a local FM station, Upendra Yadav advocated that Hindi is the lingua-franca of the Terai and practically everyone in Nepal understands Hindi. I have seen the relatives of my Madhesi friends who don’t understand Nepali and I have also seen people of non-Terai origin (in the hills and mountains) who don’t understand Hindi. Mr Yadav, practically, people speak very less and communicate through non-verbal signs. Are we supposed to include non-verbal means of communication and body language as one of our national languages too? And then make a Vice President swear in non-verbally? Practically, it might be easier to pee out open on the streets instead of having to search for a loo but I believe you won’t endorse it, or would you?

Some people have been raising a question which I think needs to be addressed. In India, English is a national language and also the language of official use. Nepali is also a national language of India, according to the Indian Constitution. According to the census of 1991, India has more than 2,076,645 people whose mother tongue is Nepali. The Nepalese census doesn’t enlist Hindi as a language spoken natively in Nepal. But independent studies suggest that about 0.05 percent of terai dwellers speak Hindi as their native language.

2. Offense against the people of Nepal

Vice President is a post of national importance. He doesn’t belong to any region or language. Nepalese of all origin and background should be able to feel pride and respect for their Vice President. Rather, he has offended a large section of Nepalese. If Mr Jha thinks he has offended only the Nepali-speaking population, so be it, but a Vice President shouldn’t offend them. Hence, he should apologize for swearing in in a foreign language.

3. Disapproval of the principle of a Federal Republic Nepal is trying to transform. From a centralized governance to a decentralized, federal republic. Because people believe that the centralized governance threatened minorities, their languages and culture, we are rewriting our constitution that will safeguard the identity of all ethnic, regional and linguistic groups. In a federal republic, regional states will have their own regional languages and systems. By not respecting his own mother-tongue and his national language, what is he hinting at? If Nepali had threatened Maithili language, how will promoting Hindi safeguard it? Is this why we fought for a federal Nepal? If we want to have one language of communication, what use restructuring the existing centralized governance? Just moving from Nepali to Hindi would cure our woes. Why did the revolution had to happen and why did so many people had to die for this simple and obvious solution ??? I wonder.

4. Failure to live up to his post

Being the first vice president means setting an example. It also means being a symbol of national unity in a country whose historically, politically, culturally and religiously accepted guardian (the erstwhile king) has taken a beating. By speaking a language that is neither listed as one of our national languages, nor is natively spoken by more than 0.05 percent of terai dwellers, what example is he trying to set? Mr. Paramananda Jha is also no saint. While acting as a Justice of the Supreme Court of Nepal, he was proven guilty of involvement in the biggest hashish (679 kg of it!!) smuggling case of Nepal. It is not a question of non-Nepali speaking people being any less Nepali than those speaking Nepali. It is a question of the dignity of the post, abiding by the rules and the situation/timing of
the act.

5. Suspicious motive

If you watch the video carefully, he speaks the first words in Nepali and then translates the rest of the text into Hindi as he speaks. Mr Jha was well aware of the act he was doing. I am sure he knew who he would please and who he would anger with his act. Language is important. Especially to smaller communities and nations. Languages are associated with their existence and identity. Even more so in a country like ours’ with very sensitive geo-political location. Languages are associated with the culture, heritage and history. Therefore there have been so violent events all over the world for linguistic rights and nations have even been divided on issues based on languages. We can’t ignore this fact based on “practical issues.”

In Paramananda Jha’s case, because of all the above mentioned reasons, the most serious question is “who was he trying to please? WHO ?” I think, the question is worth pondering.

Lastly, I Don’t Accept This Vice President for my Nepal. I will protest against his act of swearing in in Hindi both on and off the internet. And I urge you all to do the same.

  21. An official person is supposed to speak an official language. And besides, from the moment he gets in that post of Vice President he becomes a property of whole Nepal, therefore, he is supposed to represent the so called ‘4 Barna 36 Jaat’, not just a certain ethnic denomination to move along hand in hand with Nepali people..
    And then what if minister from Newari background will start talking in Newari and minister from Gurung background will start talking in Gurung language in the parliament house, and like wise Sabha Mukh Subash Nembwang shall understand in Limbu language. Just a crazy imagination, how ridiculous it would look.
    We respect every ethnic values but we should at least have a sense to come to a common logic for the sake of unification and mutual understanding. Therefore, Nepali Language is eminent and it should not be left out at any cost by any ethnic group.
    If Mr. Vice President has any any sense of hope, he must apologize.

  28. What is this fuzz all about. If pahade dont understand Hindi (which is obvious), then provide a simple solution, ‘translation’. Why don’t government provide a translated copy of Mr Jha oath script?

    This is a very strange country. Never seen the monkey job like this anywhere around. You will hardly see any country in this Earth, where people protest, burn effigy of Vice President and racist rhetoric just two days after swearing in to the post.

  29. I remember the conference held in Patana, India Where Jwalasing, Goit, MJF, and other Regional parties had asked Ramraja Prasad Singh to lead their Andolan. They had clearly stated that they would DIVIDE the country, if Singh leads them but this event became public by Mr. Singh.

    MJFs including Upendra Yadav also speaks in HINDI in CA.

    Their main aim is to divide the country, and they are doing it culturally. Somehow they are succeeding as well from the event of taking oath in HINDI.

    Who was that Gurung??? He was a Pahade . He should be hanged but because of the Nepalese rule which is made by PAHADE community, he became free.

    Atleast he is a truth person , who show his guts to let his feeling and thinking know everyone.

I really dont understand what the fuss is all about, fine the VP took his oath in Hindi, which is not a national language of Nepal. but he took an oath, he didnt refuse to take it right. you guys keep on blaming India for everything, but have you taken a look at India properly and how the ministers take the oath, there almost seem to be millions of languages and its not a hard and fast rule that all the swearing of oaths take place in only the national languages, it can take take place in any of the language in which the concerned person is fluent or comfortable in, translations are always available. You guys keep on cribbing about everything, you have no elections, the king is bad, finally you have the elections and kick the king out, but you still crib and crib and crib. So even if your country is goin to the drains you would have everything to put the blame on, your politicians and of course India. The world is facing bigger problems like food prices which is directly affecting all of us, but it seems you are destined to be fighting the wrong causes.well good luck with you all, you have lots of turmoil to look forward to.

    Open your eye Mr Upendra and be in mainstream politics and look madhesi voice not by aleniating Pahade. The day will come India will support mainstream party like Congress, Maoist , UML who is focused for the walfare of all nepali including madhesi.

    Still there is time, mend your ways and yes…think before you say anything. Things can not be easy as you think.

    The only thing I hate to see here again is, people have started calling fraction ‘pahade’ and ‘madhesi’. I thought by appointing Jha in the post of Vice President, this racial mayhem would cool down, but to my dismay, it has surmounted rather. And it is because of Mr. Vice President on the day one. Such a shame. He his simply senseless.

Truth is you (madhesi) and I (pahari) can live together with equal rights to you as much as I have or i can live with the same rights as much as you have. Either way you and me same. Fact is the people like Upendra and Paramanada Jha not helping you and myself. They are set to divide the country. These people are new kids on the block and time will tell them. They are now facing the reaps of their acts. Worst can be civil war between pahade and madhesi. I am sure such war will not last , government will stop it.

    Madhesi leadership has not that capacity and cause that brings world attention to their cause as they are not demanding separate country (what happened to Mr Ghising in darjaling, and how many people in the world know him, he was not a leader but a warrior). Upendra is not a leader and for me he also seems to be a warrior, for the autonomous cause of madhesi people. If he does something nasty, he will be crushed. Even people who fighting for right cause, have not come in frutition. Take example, Ireland, they are fighting more than 200 years but what is the result, nothing. Sikh in india could not win at all. Tamil…very hard for them too.

    Madhesi and Pahade will do better with reconciallation not by confrontation. So don’t follow Upendra and Mr Paramanada Jha. They will lead nowhere but to misery and sorrow.

    our country has problems, internal and those sponsored by india who in connivance with our corrupt leaders took our land, our rivers and reigned in on our everyday lives humiliating us with sanctions on oil, salt, this and that supplies. its easy to say but its ur own leaders, you chose them, but reality on the ground is quite different. our own politicians took advantage of the uneducated populace and through them india took further advantage.

    look around, india shares no good relations with any of its neighbors, maybe except Bhutan that too after completely reigning in on their economy, defence, and foreign policies.

    you see, taking oath in any other language is not the same in nepal as in india, esp against the backdrop of a looming and imperialistic india that have hogged any oppotunity to threaten Nepal’s sovereignty and self-respect. it is in that context why most of us reject the VP’s antics. he is supposed to be a constitutional figurehead and above partisan cheap antics like this. these behavior should limit to MPs. the VP has knowingly played the insulting card to divide people further. how can you justify this? just step aside from your jingoistic assertions of ur identity, linguistic and all, and justify if a const. post like VP should be indulging in divisive antics like this.

  53. this, in actual, is not a fuss ,rather a concern of national sovereignty and integrity.if he’s elected as a nepali to the post of VP, he should act responsibly and be a nepali. he can speak hindi as he pleases,provided he first renounce this highly respected post of VP of republic of nepal which he is not even eligible to being an indian citizen. so its high time we kicked this chap out of our mother land. india cant benefit from we being poor,we got self respect for our country and such traitors mustnt be let to breathe the holy land’s air..time to act guys..and we are ready,arent we???

    what about the Girija Prasad? He was the one who spoke in hindi at the time of agreement with Mades based parties in Baluwatar. Again He was helping Charesananda Jha to take oath in Hindi which can be seen and proved in video.

    He is the main culprit behind this. He should apologize for assisting charesananda Jha in this matter.

    It is very good thing that we are having a heated debate about an issue that has enraged a large section of Nepalese. Discussions are the only way to reach a conclusion.

    However, going through the comments section one can see that some people are retorting to sentiments rather than logic in defending their ideas. Instead of attacking a community or ethnic group, it would be better if we could clearly lay out why we do or do not accept Mr Jha as the VP.

    I, for example, don’t accept Mr Jha and the action he committed, because of the above mentioned reasons. Going by the latest developments, my stand remains the same. Because, Mr Jha just a while ago, appearing in Kantipur TV News told that he used Hindi language because his party MPRF advocates it. What a pathetic person !! If he had such desires, I think the post of Deputy Prime Minister should have been suitable for him. Because the post of Vice President is neither an executive one (so that he can forward his personal/party/regional agendas) nor should the post holder be more loyal to a party or a region.

    Sorry to be poking my nose in the ongoing discussion between you and Patriot. But I wanted to add my perspective to your last line of the latest comment, “but we have good relationship with bhutan and sri lanka.”

    That is what is the root of the problem and anti-India sentiments in Nepal. Nepalese don’t want their country to be like either of SriLanka or Bhutan. In SriLanka, Tamils are fighting a very long and bloody war for independence. They have moral and sometimes other kinds of support from their Tamil counterparts in India. In Bhutan, Indian army has a permanent presence and Indian government’s high handedness in Thimpu’s domestic affairs is not hidden from anyone. Bhutan’s Kings total acceptance to India’s ways might have provided them with some kind of benefits but the Nepali community in Bhutan (and refugees in Nepal) are the victims.

    Nepalese dont want an independence war in Nepal. But signals of separatist movements are beginning to emerge from Nepal’s plains where people of Indian origin have a considerable presence. Similarly, Nepal’s icon of nationalism and stubbornness against India, the Royal Family has taken a beating already. Nepalese army is in serious crisis because of politically sponsored plans of restructuring it, some of them are believed to be Indian plans.

    I want you to read carefully the section of Interim Constitution that elaborates on Political Parties. If I am not mistaken, Part 18 in English (Part 19 in Nepali):

    Article 141.3:
    “Political Parties with the objectives contrary to the spirit and norms of the preamble of this constitution shall not be considered qualified for the party registration.”

    Article 142.4: “The Election Commission shall not register any political party if any Nepali citizen is discriminated against becoming a member of the political party on the basis of religion, caste,tribe, language or sex or if the name, objectives, insignia or flag of such political parties is of a nature that it would disturb the religious or communal harmony or of the nature to divide the country, or such party constitution or rules are for purposes of protecting and promoting a party-less or single party system of governance.”

    An objective interpretation of these articles will make region, caste, and ethnicity based political parties like MPRF, TMDP, and NSP automatically unconstitutional, therefore prohibits from registering in the Election Commission. These parties are disturbing “communal harmony” and seeking to “divide the country.” Part of their names is “Madhes” or “Madhesi,” which directly discriminates people of other regions and language. Their objective of making Hindi language as an Official Language of Nepal contradicts with the Preamble or “Prastawana,” the core of the Interim Constitution: “sovereignty, integrity, independence and dignity of the country.”

    In summary, according to the Interim Constitution, there cannot be a political party on the basis of region, language, tribe, class, caste, or gender. Also, there cannot be a party with a name and objectives that discriminates or divides Nepali people and country on the basis of region, language, tribe, caste, or gender. Finally, there cannot be a political party that compromises or weakens “sovereignty, integrity, independence and dignity of the country.” Parties like MPRF and TMDP must be automatically nullified. But this does not mean that other political parties are not weakening “sovereignty, integrity, independence and dignity of the country,” so they all must be temporally suspended by the Election Commission. All political parties should be notified of their violation of the Constitution and should be given an opportunity to correct their behavior within a time limit if we are expecting a law abiding nation in the aftermath of the April Movement. Or else, the country will forever remain a lawless territory run by vigilantes like it has been until this time, and Nepal should lose its status as a nation in the United Nations.

Look i was just going through some articles about Sri Lanka’s problems and if you have time then i would suggest that you look it up too. If India was would have to support a diffrent country for the tamils then she have to give independence to the kashmiris because they are muslims, the nagas, mizos because they are christians and from a diffrent race, the punjabis because they are Sikhs, well in this case the whole of India would be breaking up because they have diffrent religions and diffrent customs.So why would India open up the Pandora’s box and ever support a division of Nepal. A lot of people in this site seem to think that India is the enemy no.1, well in that case you are not being a good enemy, you are supposed to study your enemy and know everything about them, but you are not, you should learn from our mistakes and see that you dont screw up where we did.     While I am well aware of the facts that you mentioned and I understand very well that Rajeev Gandhi had to lose his life for sending army to SriLanka, I thank you for the link and your suggestions on knowing more about India. I will do it in my leisure. I would like to put my points in response to yours on a point by point basis:

    1. Steven, this is what you are missing. Sending army to a neighboring country is not considered a wise diplomatic or political move anywhere in the world. (I know it was the SriLankan government who asked for military support) The US is in a mess, and many countries in the past have been in this mess. This is the “big brother” attitude, not a benevolent neighbor. You can make the warring sides engage in talks, facilitate such talks and put pressure of sorts.

    2. India doesnt want to weaken neighbours because it fears the number of its own states would increase
    => Then why did it sponsor the Bangladesh independence movement? Why was India very friendly to Maoists to the extent of even giving them a safe haven while calling them “terrorists” at the same time?

    3. I don’t think India is the enemy no. 1. I believe that India is one of the most suitable neighbors Nepal could have ever got. But there are problems and they are serious. Nepal is not like other south asian states that used to be part of india. Nepal is a sovereign and independent state for all of its history. India should stop interfering in the internal affairs of Nepal and playing the bully “big brother.”

    4. Ok, after your beer and may be after a sleep, write about Bhutan. I expect you to write about a much-talked phenomenon in Nepal, called “Sikkim-ization” too because you ought to be in a position to know more about this than I am. There are numerous things about Indo-Nepal relations that have been avoided in this discussion too, because I am not aware about whether you are familiar with them or not.

The issue confronting the nation today is poverty and lack of governance. as concerned nepalis we should all work towards alleviating the sufferings of the people and put nepal back on road to development. there is no point in sitting in cushy jobs abroad and waxing eloquent about some moron who thought he was making a political statement in a non political office. so why dont all you selfish guys return to your homeland and do your bit rather than venting your spleen on something which will not change the quality of life of the common nepali even by an iota

  105. I think, wearing Dhoti is fine. Dhoti is a ethnic dress of the resident citizens of Nepal that belongs to the community where Jha belongs. It is good promote your culture, or religion for identity.

    But taking oath in Hindi is a National Shame!! Jha’s mother tongue is not Hindi and he taking oath in Hindi seems nothing more than an act of revenge that he has within. Whatever happens in Madesh or else where we can see, but a legal action needs to be initiated against him.

    Else wait for next President from Chure Bhawar after second Ethnic Revolution, and Mr. Mainali taking oath in Chinese.

    We need to stop this foreign pleasing politics, and make a progressive Nepal. Between this has hurt MJF the most, and their main agenda of making One Madesh has gone to hell now.
    There is a thin boundary between bravery and stupidity, and Mr. VP has crossed that line.
